AN ORDINANCE AMENDING ORDINANCE NUMBER 2005-1-1 CONCERNING THE
CLOSING OF ALL CITY PARKS WITH THE EXCEPTION OF THE CHILDREN'S PARK
AS AMENDED IN ORDINANCE NUMBER 2005-1-1, DECLARING AN EMERGENCY,
AND FOR OTHER PURPOSES.
WHEREAS, The city parks have been and continue to be the target of vandalism, theft, property
damage, litter and other acts that are a danger to the safety and well being of the patrons of the
city parks and other property owners surrounding the city parks.
NOW THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BATESVILLE, ARKANSAS,THAT ORDINANCE NUMBER 2005-1-1, IS HEREBY
AMENDED AS FOLLOWS:
SECTION 1. Section 1 of Ordinance No. 2005-1-1 is hereby amended to read: That
ALL city parks shall be closed from 12:00 MIDNIGHT and reopen at 5:00
a.m..
SECTION 2. That the hours of the Children's Park, located within Riverside Park, shall
remain as amended in Section 1. of Ordinance 2005-1-1.
SECTION 3. Appropriate signage shall be placed on site to advise as to the times when
the parks are opened and closed.
SECTION 4. That all other provisions of Ordinance Numbers 2004-9-2 and 2005-1-1,
not in conflict herewith shall remain in full force and effect.
SECTION 5. EMERGENCY CLAUSE. Due to the fact that vandalism,theft, property
damage, litter and other acts that are a danger to the safety and well being
of the patrons of the City Parks and surrounding property owners, an
Emergency is hereby declared to exist and this ordinance shall be in full
force and effect from and after it passage for the public peace, health and
safety.
