ORDINANCE NO.
AN ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICTS MAP; AND FOR
OTHER PURPOSES.
WHEREAS, Rich Realty, with the agreement of Merchants & Planters Bank requested that
the below described property be re -zoned from Single -Family Residential (R-2) to Commercial
Community (C-1) in order to the actual uses of said property; and,
WHEREAS, the Batesville Planning Commission has reviewed the relationship of this
property with the Comprehensive Plan and determined that the requested re -zoning was entirely
consistent with said Plan; and,
WHEREAS, the Batesville Planning Commission conducted a properly advertised public
hearing at a regularly scheduled meeting on March 3, 2025 to consider said proposed amendment to
the Zoning Districts Map; and,
WHEREAS, the Batesville Planning Commission voted at its regularly scheduled meeting on
March 3, 2025 to approve the requested amendment to the Zoning Districts Map as being in the best
interest of the future development of the City of Batesville, and further recommends that the
Batesville City Council adopt said amendment to the Zoning Districts Map.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BATESVILLE, ARKANSAS THAT THE BATESVILLE ZONING DISTRICTS MAP IS
HEREBY AMENDED AS FOLLOWS:
Section 1: For the following described property, from Single -Family Residential (R-1) to
Commercial Community District (C-1) zoning classification, as displayed on Exhibit A
attached hereto:
Part of the Southeast Quarter of the Southeast Quarter (SE '/4 SE '/4) of Section 15,
Township 13 North, Range 6 West, in the City of Batesville, Independence County,
Arkansas, being more particularly described as follows: Commencing at a locally
accepted corner per PLS #929 for the Northwest corner of said Southeast Quarter of the
Southeast Quarter (SE'/4 SE'/4) of Section 15, then run S87°3615511E, 21.43 feet to an
iron pin on the East R/W Line of 301 Street, said point being the true point of beginning,
then continue S87°36'55"E, 119.73 feet to an iron pin, then run S03°12' 12"W, 293.92
feet to an existing iron pin on the R/W line of Arkansas Highway #69 stamped PLS
#1120, then run along said highway R/W line as follows: N79°52'31"W, 12.91 feet to
PLS #1120 iron pin, then run S10°07'29"W, 17.68 feet to PLS #1120 iron pin, then run
N80020'52", 86.00 feet to PLS #1120 iron pin, then run N38057' 10"W, 28.07 feet to PLS
# 1120 iron pin being on the east R/W line of 30" Street, then run NO2°57'27"E along the
east R/W line of 30'h Street a distance of 277.83 feet back to the point of beginning,
containing 0.82 acre, more or less, and being subject to all recorded rights -of -way and
easements.
Easement Legal Description
Part of the Southeast Quarter of the Southeast Quarter (SE '/4 SE '/4) of Section 15,
Township 13 North, Range 6 West, in the City of Batesville, Independence County,
Arkansas, being more particularly described as follows: Commencing at a locally
accepted corner per PLS #929 for the Northwest corner of said Southeast Quarter of the
Southeast Quarter (SE'/4 SE'/4) of Section 15, then run S87°36'55"E, 21.43 feet to an
iron pin on the East R/W Line of 301 Street, said point being the true point of beginning,
then continue S87°36'55"E, 119.73 feet to an iron pin, then run S03°12' 12"W, 72.89 feet
to an iron pin being 5 feet southerly from the back of an existing curb and gutter, then run
along a line being 5 feet south of the top of an existing curb and gutter as follows:
N64043'00"W, 67.23 feet, then S88°36'0111W, 57.40 feet to an iron pin on said east R/W
line of 301 Street a distance of 50.52 feet back to the point of beginning, containing 0.15
acre, more or less, and being subject to all recorded rights -of -way and easements.
The foregoing also described as Assessor parcel id numbers 1100376007C and
1100376001C.
Section 2: IF ANY PORTION OR PORTIONS OF THIS ORDINANCE ARE DEEMED OR
HELD TO BE INVALID, SUCH INVALIDITY SHALL NOT AFFECT THE
REMAINING PORTION OR PORTIONS OF THIS ORDINANCE.
IT IS SO ORDAINED.
