ORDINANCE NO.
AN ORDINANCE AMENDING THE ORDINANCE REGARDING COMPOSITION OF THE BATESVILLE
AIRPORT COMMISSION; AND FOR OTHER PURPOSES
WHEREAS, currently Ord. No. 2008-07-1, Sec. 1, codified as 2.44.01 establishes the
airport commission which is composed of five members, with three being required to be
residents of the city of Batesville;
WHEREAS, Arkansas Code Annotated § 14-359-104 now requires that the municipal
airport commissions be composed of seven members;
WHEREAS, Arkansas Code Annotated § 14-359-105 addresses how these two additional
appointments are to be made;
WHEREAS, that Ord. No. 2008-07-1, Sec. 1, Codified as 2.44.01 and Ord. No. 733, Sec. 2
Codified as 2.44.02 need to be amended in order to be compliant with State law.
THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF BATESVILLE, ARKANSAS:
Section 1. Amending Chapter 2.44.01 (Ord. No. 2008-7-1, Sec. 1) of the Batesville City
Code:
That Section 2.44.01 (Ord. No. 2008-7-1, Sec.1) and 2.44.02 (Ord. No. 733, Sec. 2) of the
Batesville City Code are amended to read as follows:
Section 2.44.01 Creation There is hereby created a Commission to be known as the
Batesville Aviation Commission, to be composed of seven (7) members who are qualified
electors of the State. Of the seven (7) members of the Batesville Aviation Commission four (4)
shall be residents and qualified electors of the city of Batesville, Arkansas. At least one (1) of
the members shall be fully experienced in aviation holding some type of pilot aeronautical
rating. If there is not any experienced in aviation, holding some type of pilot aeronautical
rating, who is available or willing to serve on the commission, then the city council may waive
this requirement. No more than (1) member of the commission may have financial dealings or
interests in an aeronautical enterprise while a member of the commission.
Section 2.44.02 Method of appointment, terms of office Said Commissions shall be
appointed by the mayor and confirmed by a three fourths (3/4) vote of the duly elected and
qualified members of the city council, and shall hold office for a term of five (5) years; provided,
however that the commissioners First appointed shall serve for terms of one (1), two (2), three
(3), four (4) and five (5) years each, to be designated by the mayor, and thereafter shall be
appointed for a term of five (5) years in the manner set forth above. That the initial terms of
the two (2) new members upon First appointment to the respective positions shall be as
follows: One (1) new member shall serve an initial term of four (4) years; and One (1) new
member shall serve an initial term of five (5) years, to be designated by the mayor. After said
initial appointment, the terms for each respective position shall be five years.
Section 2. Repealing conflicting Ordinances:
That any other Ordinances found to conflict with this Ordinance are hereby repealed.
Section 3: Invalidity
If any portion or portions of this ordinance are deemed or held to be invalid, such
invalidity shall not affect the remaining portions of this ordinance.
Section 4: Emergency Clause
That the need for the airport commission to be in compliance with state law is
immediate. Therefore, an emergency is hereby declared to exist, and this Ordinance shall be in
full force and effect from the date of its adoption
