ADJOURNMENT Batesville- My Hometown... Make it Yours! ORDINANCE NO. AN ORDINANCE REGARDING REMOVAL OF APPOINTED COMMISSIONERS; AND FOR OTHER PURPOSES WHEREAS, Arkansas Code Annotated § 14-42-110 allows the City Council to provide by Ordinance for the removal of Commissioners by a majority vote of the council; and WHEREAS, the Council wishes to have the authority to remove Commissioners for Cause by a three -fourths (3/4) majority vote; THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF BATESVILLE, ARKANSAS: Section 1. Amending Title 1-General Provisions of the Batesville Municipal Code by adding the following Section to be Codified as 1.40 to the Batesville City Code: Section 1.40 Removal of Commissioner That a Member of any Commission appointed under the City of Batesville's Municipal Code and/or Ordinances may be removed for cause upon a vote of three -fourths (3/4) of the duly elected members of the City Council. Section 2. Repealing conflicting Ordinances That any other Ordinances found to be conflict with this Ordinance are hereby repealed. Specifically, Ordinance, Number 733, Section 4, codified as 2.44.04 under the City Municipal Code is hereby repealed. Section 3: Invalidity If any portion or portions of this ordinance are deemed or held to be invalid, such invalidity shall not affect the remaining portions of this ordinance. Section 4: Emergency Clause That the need for commissioners to be in compliance with city and state law is immediate. Therefore, an emergency is hereby declared to exist, and this Ordinance shall be in full force and effect from the date of its adoption PASSED AND APPROVED THIS TH DAY OF APRIL, 2026.
