AN ORDINANCE TO AMEND SEVERAL PROVISIONS OF TITLE 14 ZONING OF THE
BATESVILLE MUNICIPAL CODE; AND FOR OTHER PURPOSES.
WHEREAS,the Batesville Planning Commission determined that Chapters 14.13, 14.20 and 14.28
of Title 14 of the Batesville Municipal Code were either relevant to the earlier adoption of ordinances or
have long since been superseded by subsequent ordinances;and,
WHEREAS,the Batesville Planning Commission recommends the revision of chapter 14.13 by
revision of the title and deletion of the current text, and,
WHEREAS,the Batesville Planning Commission further recommends deletion of chapters 14.20,
and 14.28 to avoid any confusion with current provisions of the Title; and,
WHEREAS,the Batesville Planning Commission conducted a properly advertised public hearing on
May 4,2026 to provide public with an opportunity to consider said amendments;and,
WHEREAS,the Batesville Planning Commission,at its regular meeting on May 6,2026,
recommended,by unanimous vote,that said recommended revisions to Title 14 Zoning be adopted by the
Batesville City Council.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BATESVILLE,ARKANSAS:
Section 1. Chapter 14.13 of Title 14 is hereby amended by-replacing the existing title with
"Reserved"and deleting all existing sections and text.
Section 2. Chapter 14.20 of Title 14 is hereby deleted in its entirety.
Section 3. Chapter 14.28 of Title 14 is hereby deleted in its entirety.
IF ANY PORTION OR PORTIONS OF THIS ORDINANCE ARE DEEMED OR HELD TO
BE INVALID,SUCH INVALIDITY SHALL NOT AFFECT THE REMAINING PORTION OR
PORTIONS OF THIS ORDINANCE.
IT IS SO ORDAINED.
