ORDINANCE NO. AN ORDINANCE AMENDING EMPLOYEE HANDBOOK FOR THE CITY OF BATESVILLE AND BATESVILLE MUNICIPAL AIRPORT WHEREAS, from time to time it is necessary to review and amend the City's Employee Handbook; and WHEREAS, it is in the City's best interest to keep our policies current with the changing state and federal laws. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS, SECTION 1: The amendments to the Employee Handbook for the City of Batesville and Batesville Municipal Airport are attached hereto and incorporated herein by reference is hereby adopted. PASSED AND APPROVED this day of 2026. Rick Elumbaugh, Mayor ATTEST: Jessica Davis, City Clerk RESOLUTION # A RESOLUTION AUTHORIZING THE SALE OF THE PROPERTY LOCATED AT 6465 BETHESDA ROAD. WHEREAS, the City of Batesville acquired a small office in Bethesda located at 6465 Bethesda Rd. when the City of Batesville when it took over Bethesda Water; and WHEREAS, that the City of Batesville and the Batesville Water Utility have no need for said office; and WHEREAS, Andy Konkler and Candy Konkler wish to purchase said property for $45,000 which is the amount for which it appraised. NOW, THEREFORE BE IT RESOLVED, BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS SECTION 1: That the City of Batesville hereby authorizes the sale of 6465 Bethesda Rd, Batesville, Arkansas for the purchase price of $45,000, more or less to Andy Konkler and Candy Konkler ("Buyers"), in the form of a quitclaim deed from the City with deed stamps and filing fees being born by the buyers. Rick Elumbaugh, Mayor City of Batesville, Arkansas ATTEST: Jessica Davis, City Clerk City of Batesville, Arkansas ORDINANCE NO. 2026 - AN ORDINANCE TO ADD A SECTION TO CHAPTER 14.08 OF TITLE 14 - ZONING OF THE BATESVILLE MUNICIPAL CODE; AND FOR OTHER PURPOSES. WHEREAS, the Batesville Planning Commission was made aware of the fact that Section 4 of Ordinance 2026-02-01 (Exhibit B) was inadvertently missing an intended proposed section; and, WHEREAS, the Batesville Planning Commission conducted a properly advertised public hearing on August 3, 2026 to provide public with an opportunity to consider to correcting said omission; and, WHEREAS, the Batesville Planning Commission, at its regular meeting on August 3, 2026, recommended, by unanimous vote, that said recommended revisions to Title 14 Zoning be adopted by the Batesville City Council; and, WHEREAS, the Council concurs that adding the missing section completes the meaning of Chapter 14.08. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, ARKANSAS: Section 1. Chapter 14.08 of Title 14 is hereby amended by inserting the following language before Section 14.08.02: "Sections 14.08.01 District Descriptions 14.08.02 Permitted Uses 14.08.03 Area Requirements 14.08.01. District Descriptions A. Light Industrial District [I-1] The 1-1 Light Industrial District is intended to accommodate light industrial, wholesale and research establishments including light manufacturing and machinery operations that are so conducted that noise, odor and glare of each operation is confined completely within an enclosed structure. The district is also intended to accommodate sexually oriented businesses whether they are of a wholesale or retail nature. The Industrial Districts specifically exclude residential dwelling units on the theory that the mixture of residential uses and the location of sexually oriented businesses and industrial uses is contrary to the purposes of these regulations. B. General Industrial District [I-2] The 1-2 General Industrial District is intended to accommodate those industrial uses which may not or cannot meet standards of the 1-1 District and is also intended to accommodate sexually oriented businesses whether they are of a wholesale or retail nature. The Industrial Districts specifically exclude residential dwelling units on the theory that the mixture of residential uses and industrial and the location of sexually oriented businesses is contrary to the purposes of these regulations." IF ANY PORTION OR PORTIONS OF THIS ORDINANCE ARE DEEMED OR HELD TO BE INVALID, SUCH INVALIDITY SHALL NOT AFFECT THE REMAINING PORTION OR PORTIONS OF THIS ORDINANCE. IT IS SO ORDAINED.
