HomeMy WebLinkAbout2009-06-02 ORDINANCE NO. — • AN ORDINANCE TO AMEND ORDINANCE NO. 2007-11-2 CONCERNING THE HISTORIC DISTRICT COMMISSION WHEREAS, the City of Batesville enacted Ordinance Number 2007-11-2 which established the Historic District Commission, and WHEREAS, the City.of Batesville desires to amend said ordinance to clarify the membership of said Historic District Commission. NOW THEREFORE, be it ordained that Section 1, Creation and Members, Sub-paragraph(B) is hereby amended to read as follows: "The historic district commission shall consist of nine (9) members appointed by the Mayor with the advice and consent of the City Council. Members shall be electors of the City of Batesville holding no salaried or elective municipal office and shall include at least one (1) person who owns property within the proposed historic district. Members shall demonstrate a positive interest in historic preservation, possessing interest or expertise in architecture, history, urban or regional planning, building rehabilitation, real estate, or preservation or conservation in general." • SEVERABILITY: If any provision, including any exception, part, phrase, or term, or the application thereof to any person or circumstance(s) is held invalid, the application to other persons or circumstances shall not be affected thereby, and the validity of this ordinance in any and all respects shall not be affected thereby. EMERGENCY CLAUSE: In consideration of the public interest to be preserved, an emergency is hereby declared to exist and this Ordinance being necessary for the immediate preservation of the public peace, health and safety, shall be in full force and effect immediately from and after the date of its passage.
