AN ORDINANCE AMENDING ORDINANCE NUMBER 2009-64 OF THE CITY OF BATESVILLE,ARKANSAS CONCERNING WATER RATES WHEREAS, the City of Batesville, Arkansas owns and operates a water treatment and distribution system that delivers water to its citizens and also sells and delivers wholesale water to other municipalities,water associations, improvement districts, and other legal entities, and WHEREAS, Ordinance Number 2009-6-4 repealed then-existing water rates charged by the City and established a new rate structure for all classes of users, and WHEREAS, the need exists to modify certain provisions within said new rate structure to exempt certain wholesale users from unreasonable minimum usage charges within the contracts negotiated with them. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF BATESVILLE,ARKANSAS THAT: "Section 3.7 Wholesale User Rates" is hereby amended to read as follows: "Any municipality,water association, improvement district, or other legal • entity which purchases water for resale shall purchase 0-1000.gallons per month at a rate to be fixed by contract or the minimum charge for 0-1000 gallons of monthly water usage charged to customers outside the city limits per meter size. All the water in excess of the first thousand (1000) gallons per month shall be purchased by wholesale customers at a rate to be fixed by contract, but not less than$2.09 per thousand gallons." "Section 4.7 Wholesale User Rates" is hereby amended to read as follows: j "Any municipality,water association, improvement district, or other legal j entity which purchases water for resale shall purchase 0-1000 gallons per month at a rate to be fixed by contract or the minimum charge for 0-1000 gallons of monthly water usage charged to customers outside the city limits per meter size. All the water in excess of the first thousand(1000) gallons per month shall be purchased by wholesale customers at a rate to be fixed by contract,but not less than $2.44 per thousand gallons." • EMERGENCY CLAUSE: In consideration of the public interest to be preserved, AN. EMERGENCY is hereby declared to .exist and this Ordinance being necessary for the immediate preservation of the public peace, health and safety, shall be in full force and effect immediately from and after the date of its passage.
