ORDINANCE No. 2009- 9 2
AN ORDINANCE ACCEPTING THE DEDICATION OF A CITY
STREET KNOWN AS VALLEY VIEW ROAD TO THE CITY OF
BATESVILLE, ARKANSAS
WHEREAS, Al Crouch (Mountain Ridge Development, LLC) has executed and
delivered to the City of Batesville, Arkansas, its Deed of Dedication for the purpose of a
city street, known as Valley View Road, an easement across the following described
property; subdivision known as The Village at Eagle Mountain located within the city of
Batesville:
PROPERTY DESCRIPTION
A tract of land being a part of the Southwest 1/4, Section 24 and a part of the Northwest 1/4,
Section 25, T 13 N, R 6 W, in the City of Batesville, Independence County, Arkansas, more particularly described as follows:
Commencing at the Northwest corner of said Section 25,
thence S 87'50'23" E, along the north line of said Section 25, 910.40 feet;
thence S 02'09'37" W, 28.37 feet to the north right of way line of Mountain Ridge Road and the point of beginning;
thence N 30'48'31" E, 139.67 feet;
thence N 59'56'40" E, 105.34 feet;
thence N 71'56'36" E, 102.45 feet;
thence N 85'50'36" E. 102.18 feet;
thence S 66'20'51" E, 72.04 feet;
thence S 82'16'57" E, 60.81 feet;
thence S 89'49'05" E, 264.06 feet;
thence S 09'38'30" E, 112.97 feet;
+hence S 43'01'54" E, 89.75 feet to the northwest corner of Lot 27,
)untain Ridge Subdivision;
ence along the west line of said Lot 27, S 31'15'14" W, 453.37 feet to the
north right of wayline of said Mountain Ridge Road;
thence along soldnorthright of way line the following;
N 61'49'23' W. 125.96 feet;
along a curve to the right, said curve having a radius of 327.02 feet, an arc length of 92.28
feet, a long chord bearing and distance of N 53'4420' W, 91.97 feet
N 45'39'18 W, 268.88 feet;
along a curve to the left, said curve having a radius of 274.99 feet, an arc length of 160.28 feet,
a long chord bearing and distance of N 62'2110 W, 155.02 feet;
N 79'03'16"W, 81.28 feet to the point of beginning.
This tract contains 6.47 acres, more or less, and is subject to any and all easements.
WHEREAS, the said Valley View Road has been constructed in accordance with the
requirements of the City of Batesville; and has received a final plat approval from the
Batesville Planning Commission on 12-14-09; and the public benefit will be served by
the acceptance and maintenance of Valley View Road.
BE IT THEREFORE ORDAINED BY THE CITY COUNCIL OF BATESVILLE,
ARKANSAS:
That the City of Batesville hereby accepts for purposes of maintenance,the public
street known as Valley View Road.
This ordinance adopted this 22nd day of December 2009.
