CITY OF BATESVILLE, ARKANSAS
A RESOLUTION AWARDING THE CONTRACT FOR ACQUIRING,
CONSTRUCTING AND EQUIPPING EXTENSIONS, BETTERMENTS AND
IMPROVEMENTS TO THE SEWER FACILITIES OF THE CITY OF
BATESVILLE TO THE COMPANY SUBMITTING THE LOWEST BID
WHEREAS, there was submitted to the qualified electors of the City of
Batesville, Arkansas at a special election held March 10, 2009, the question of
issuing capital improvement bonds for the purpose of financing all or a portion of
the costs of acquiring, constructing and equipping extensions, betterments and
improvements to the City's sewer system; and
WHEREAS, at the special election, a majority of the electors voting on the
question approved the issuance of the bonds and the levy of a new sales and use tax
at the rate of 1% to retire the bonds;
WHEREAS, the City of Batesville has advertised for bids in accordance with
• Arkansas state law for a part of the project to acquire, construct and equip
extensions, betterments and improvements to the City's sewer system; and
WHEREAS, the bids received by the City were examined beginning on June
28, 2011; and
WHEREAS, BRB Contractors, Incorporated submitted the lowest bid, and
that bid has been reviewed by the City and found to be in compliance with the bid
specifications.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL
OF THE CITY OF BATESVILLE, ARKANSAS:
THAT, any acceptance of a bid is expressly conditioned upon approval of the
bid by the Arkansas Natural Resources Commission; and
THAT, subject to the preceding condition, the bid received from BRB
Contractors, Incorporated should be and is hereby accepted.
