AN ORDINANCE REZONING 25.14 ACRES OF ANNEXED PROPERTY OWNED BY THE UNIVERSITY OF ARKANSAS COMMUNITY COLLEGE AT BATESVILLE FROM R-1 TO R-2 RESIDENTIAL;DECLARING AN EMERGENCY AND OTHER PURPOSES. BE 1T ORDAINED BY THE CITY OF BATESVILLE AS FOLLOWS: (1) The following property be and the same is hereby rezoned from R-1 Residential to R- 2 Residential. In accordance with municipal ordinance 9999, section IV, subsection 4, all annexed property within the corporate limits of the City of Batesville is required to have a public hearing conducted by the city planning commission for the determination of the most appropriate zoning for the annexed property. The Batesville Planning Commission conducted a public hearing on January 07, 2002 and has recommended that the zoning remain consistent with the original campus. (2) The property is described as thus: A tract of land being a part of Section 2 and a part of Section 3 all in T 13 N,R 6 W in Independence County,Arkansas,more particularly described as follows:beginning at a point on the north right of way line of White Drive said point being 49.92 feet north and 20.02 feet west of the southeast corner of said Section 3;thence N 89* 56' 01" W along said north right of way line, 852.13 feet to the centerline of Pfeiffer Creek; thence along said centerline the following: N 06° 12' 03" W 226.00 feet;N 19° 52'46" E 136.22 feet;N 32° 18'43" E 125.14 feet;N 190 12'04"E 426.55 feet; N 190 15' 42" W 201.25 feet; N 19° 13' 05" E 193.33 feet; thence N 88° 57' 32" E 882.99 feet to the extension of a wire fence; thence S 02° 31' 15" W along said extension and along said fence, 731.90 feet; thence S 89° 41' 48" W 210.39 feet; thence S 01' 35' 55" W 518.83 feet to the point of beginning. Containing 25.14 acres, more or less, subject to any and all easements. (3) It is hereby found and declared that an emergency exists and that this ordinance being necessary for the public welfare, it shall be in full force and effect from the date of its passage.
