• IdW <br /> • ORDINANCE NO.C>X)c <br /> AN ORDINANCE AUTHORIZING THE CITY TO BECOME A CERTIFl<ED <br /> AFFILIATE OF KEEP ARKANSAS BEAUTIFUL FOR THE PURPOSE OF <br /> PARTICIPATING IN LITTER CONTROL PROGRAMS CONDUCTED BY THIS <br /> ORGANIZATION AND TO QUALIFY FOR PROVISIONS OF ACT 145 OF 2001 <br /> OF THE ARKANSAS GENERAL ASSEMBLY, ARKANSAS CODE 8-6-404. <br /> SECTION 1. Pursuant to provisions of Act 145 of 2001 of the Arkansas General <br /> Assembly, Arkansas Code Section 8-6-404, the Mayor is hereby authorized and directed <br /> to make application and to take necessary actions for the purpose of qualifying the City <br /> of Batesville as a certified affiliate of the Keep Arkansas Beautiful(KARB) organization. <br /> Act 145 of 2001 provides that local governments affiliating with this organization <br /> are enabled to participate in litter control programs conducted by KARB and to receive <br /> fines for littering collected in its jurisdiction. <br /> SECTION 2. The Mayor is further authorized to remit $50.00 to Keep Arkansas <br /> Beautiful organization as a membership fee in said organization, with the remittance to be <br /> charged to the Mayor's City General Discretionary Fund. <br /> OSECTION 3. Severability. If any part of this ordinance shall be held void, such <br /> part shall be deemed severable, and the invalidity thereof shall not affect the remaining <br /> parts of this ordinance. <br /> SECTION 4. All Ordinances and parts of ordinances in conflict with this <br /> ordinance are hereby repealed. <br /> SECTION 5. EMERGENCY CLAUSE: Due to the fact that littering is an <br /> immediate and continuing problem, it is hereby found that an emergency exists and this <br /> ordinance being necessary ryfo <br /> r the public peace, health and safety shall be in full force and <br /> effect from the date of its passage. <br /> DATED: ().3 <br /> APPROVED <br /> /n ayor <br /> ATTEST: UL r4,1-j �- <br /> City Clerk <br />
