HomeMy WebLinkAbout2003-06-02 • ORDINANCE AN ORDINANCE REGULATING PARKING AND DRIVING WITHIN RIVERSIDE PARK IN BATESVILLE, ARKANSAS, DECLARING A PENALTY FOR VIOLATION AND FOR OTHER PURPOSES. WHEREAS, it is the intent of the Batesville City Council to maintain the integrity and safety of Riverside Park in Batesville, Arkansas for all citizens and visitors; and WHEREAS, it has been determined that certain actions need to be taken to achieve the integrity and safety of said park. BE IT THEREFORE ORDAINED BY THE CITY COUNCIL OF BATESVILLE, ARKANSAS: SECTION 1. Riverside Park is determined by boundaries where signs are posted as • "Riverside Park" and includes the entire Batesville Riverwalk. SECTION 2. Parking shall be permitted only in designated parking places indicated by WHITE STRIPED PARKING PLACES. For events requiring special attention and relief from this ordinance, the mayor or his designated agent may grant such relief. SECTION 3. Driving in park—Except for city employees working in Riverside Park when such is needed, vehicles are prohibited from driving on the grass or unpaved areas. SECTION 4. Littering—Littering shall not be permitted in any part of Riverside Park and any penalties shall be governed by Act 145 of 2001 of the Arkansas General Assembly commencing with Arkansas Code Section 8-6-404 and for reference purposes this is consistent with Batesville City Ordinance Number 2003-6-1. SECTION 5. Except as referenced in Section 4, any person violating any provision of this ordinance shall be deemed guilty of a misdemeanor and punished by a fine of not less than $100.00 and not more than $250.00 with damages, if any, to be applied in addition to said punishment. If such violations continue each violation shall be a separate offense. SECTION 6. Severability—If any part of this ordinance shall be held void, such part shall be deemed severable, and the invalidity thereof shall not affect the remaining parts of this ordinance. SECTION 7. All ordinances and parts of ordinances in conflict with this ordinance are hereby repealed. EMERGENCY CLAUSE —Due to the fact that problems addressed are current and on going, an emergency is declared to exist and is necessary to protect the public peace, health and safety, this ordinance shall be in full force and effect from and after its passage.
