ORDINANCE NUMBER
AN ORDINANCE REZONING 36.67 ACRES OF PROPERTY LOCATED IN QUAIL
VALLEY FROM R-2 RESIDENTIAL TO R-1 SINGLE FAMILY RESIDENTIAL;
DECLARING AN EMERGENCY AND OTHER PURPOSES.
BE IT ORDAINED BY THE CITY OF BATESVILLE AS FOLLOWS:
SECTION 1.
(1) The following property be and the same is hereby rezoned from R-2 Residential
to R-I Single Family Residential. In accordance with the City of Batesville
Zoning Code the Batesville Planning Commission conducted a public hearing on
Monday, September 09, 2002 and has recommended that the property be rezoned
from R-2 to R-1.

A tract of land being a part of the SWI/4 of Section 13, T 13 N. R 6 W in the City of Batesville,
Independence County, Arkansas, more particularly described as follows:
commencing at the southeast corner of said SW/14;
thence N 00 '49'52" E along the east line of said SWI/4, -157.0 feet to the point of beginning;
thence N 72007'23" W. 297.83 feet;
thence N 46 '57'03" W. 50.00 feet to the north right of way line of South Quail Valley Drive:
thence along said north right of way line the following:
southwesterly along a curve to the right, said curve having a radius of 180.74 feet and an arc
length of 145.63 feet:
thence S 89'12'40" W, 381.83 feet;
thence N 87 '21 '00' W. 75.87 feet to the southeast corner of the Clouse tract;
thence N 02'39' E, 499.29 feet to the northeast corner of said Clouse tract and the South line
thence N 87 '21 ' W, 610.0 feet to the northwest corner of the Clouse tract and
the east right of way line of Thunderbird Drive;

This tract contains 36.67 acres, more or less.

SECTION 3. SEVERABILITY: If any part of this ordinance shall be held void, such
part shall be deemed severable, and the invalidity thereof shall not affect the remaining
parts of this ordinance.
SECTION 4. EMERGENCY CLAUSE: It is hereby found and declared that an
emergency exists and that this ordinance being necessary for the public welfare, it
shall be in full force and effect from the date of its passage.
