10 ORDINANCE NUMBER 2003-10-3
AN ORDINANCE AMENDING ORDINANCE NUMBER 98-1-39 SECTION
TWO, IN WHICH AN ADDITIONAL FIVE YEARS IS GRANTED FOR A
CABLE FRANCHISE WITHIN THE CITY OF BATESVILLE, ARKANSAS,
DECLARING AN EMERGENCY AND FOR OTHER PURPOSES.
WHEREAS, the Batesville City Council did grant a fifteen(15)year Cable TV
Franchise in Section 2 of ordinance number 98-1-3 after TCA Cable partners
made a request for the extension commencing April 14, 2000 and ending April 14,
2015; and
WHEREAS, it is now determined that a five year extension is in order and is in the best
interest of the city and its citizens.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
BATESVILLE, ARKANSAS THAT:
Section 1. An extension is granted for an additional five(5)years commencing April 14,
2000, and ending on April 14, 2020.
Section 2. In Ordinance 98-1-3 to meet the conditions of Section I of this ordinance,
Section 2 is hereby amended to reflect the actual franchise period to be from April 14,
2000 to April 14, 2020
Section 3. All other ordinances, agreements and parts of ordinances and agreements
in conflict with the provisions are hereby repealed.
EMERGENCY CLAUSE: Due to the complexities of the existing cable TV franchise
and the city acting in a timely manner regarding future fees, an emergency is hereby
declared to exist and this ordinance for the public peace, welfare and safety shall be
in fiill force and effect from and after its passage and approval.
