AN ORDINANCE PROVIDING FOR AN INCREASE IN FRANCHISE FEES
IMPOSED UPON COX COMMUNICATIONS WITHIN THE CITY OF
BATESVILLE, ARKANSAS, AND REPEALING ORDINANCE
NUMBER 2003-2-1
WHEREAS, pursuant to Ordinance Number 2003-10-3 granting a five (5) year
extension to Cox Communications for a cable TV non-exclusive franchise; and
WHEREAS, the City of Batesville now imposes a revised fee schedule in the best
interest of all parties.
Section 1. TCA Cable Partners, d/b/a Cox Communications shall pay to the City of
Batesville on a quarterly basis, effective January 1, 2004 the amount of 3.00% of
revenues collected from residential, commercial and industrial customers within the
City of Batesville, Arkansas. Said fee will be paid to the city by the 20'h of each
month following each quarter. For clarification, the first payment under this ordinance
shall be payable by April 20, 2004.
Section 2. The City of Batesville shall have the right to increase the franchise fee on
gross subscription receipts up to the maximum permitted by law during the term of this
agreement provided however, that Grantee is given a minimum of thirty(30)days
advance notification in writing.
Section 3. Ordinance 2003-2-1 is hereby repealed and the city clerk shall mark
Ordinance Number 2003-2-1 to show it repealed.
Section 4. Except as amended, the franchise shall remain in fidl force and effect subject
to Federal, state and local law and is hereby ratified and confirmed in all respects.
Section 5. All other ordinances and parts of agreements in conflict with provisions of
this ordinance are hereby repealed.
