ORDINANCE NO. oCCb3-1 l-f <br /> AN ORDINANCE AMENDING ORDINANCE NUMBER 935, SECTION 2,FOR <br /> THE PURPOSE OF PROVIDING ADDITIONAL EXCEPTIONS, DECLARING <br /> AN EMERGENCY AND FOR OTHER PURPOSES. <br /> WHEREAS,there are times when ordinances need to be updated to achieve the common <br /> good for the citizens of Batesville. <br /> NOW, THEREFORE, be it ordained by the City Council of Batesville, Arkansas: <br /> Section 2. It shall not be a violation of this ordinance if said Roman candle, firecracker, <br /> sky rocket or other firework is exploded or set off in order to scare off or prevent the <br /> roosting of blackbirds or other birds in the city limits provided that the mayor or his <br /> designated agent has declared an emergency situation to exist and the user of said <br /> fireworks has obtained authorization from the mayor or his designated agent to use the <br /> fireworks; said authorization shall state specific times, dates, and places on which the <br /> fireworks may be used. <br /> FURTHER, the mayor is hereby authorized to issue other exemptions if there is a <br /> reasonable need which will benefit the City of Batesville. The mayor shall proceed <br /> with caution in a limited manner and this exception is to be truly an exception and <br /> not the general rule. <br /> EMERGENCY CLAUSE: Due to the request of Batesville High School and the Pioneer <br /> Booster Club to use fireworks on Batesville High School property for a state football <br /> playoff game on November 21, 2003, an emergency is hereby declared to exist and this <br /> ordinance being necessary for the public peace, welfare and safety shall be in full force <br /> and effect from and after its passage. <br /> APPROVED: <br /> Mayor Joe M.
