AN ORDINANCE AMENDING ORDINANCE NUMBER 935, SECTION 2,FOR
THE PURPOSE OF PROVIDING ADDITIONAL EXCEPTIONS, DECLARING
AN EMERGENCY AND FOR OTHER PURPOSES.
WHEREAS,there are times when ordinances need to be updated to achieve the common
good for the citizens of Batesville.
NOW, THEREFORE, be it ordained by the City Council of Batesville, Arkansas:
Section 2. It shall not be a violation of this ordinance if said Roman candle, firecracker,
sky rocket or other firework is exploded or set off in order to scare off or prevent the
roosting of blackbirds or other birds in the city limits provided that the mayor or his
designated agent has declared an emergency situation to exist and the user of said
fireworks has obtained authorization from the mayor or his designated agent to use the
fireworks; said authorization shall state specific times, dates, and places on which the
fireworks may be used.
FURTHER, the mayor is hereby authorized to issue other exemptions if there is a
reasonable need which will benefit the City of Batesville. The mayor shall proceed
with caution in a limited manner and this exception is to be truly an exception and
not the general rule.
EMERGENCY CLAUSE: Due to the request of Batesville High School and the Pioneer
Booster Club to use fireworks on Batesville High School property for a state football
playoff game on November 21, 2003, an emergency is hereby declared to exist and this
ordinance being necessary for the public peace, welfare and safety shall be in full force
and effect from and after its passage.
