AN ORDINANCE AMENDING THE BATESVILLE ZONING CODE, SECTION XI,
II, A(DESIGN PARAGRAPH 2), (2), REQUIRING PUBLIC OR PRIVATE PARKING
AREAS INCLUDING OPEN SALES AND STORAGE AREAS TO BE IMPROVED
WITH A PAVED OR CONCRETE SURFACE; AND TO REQUIRE EXISTING
PARKING LOTS TO BE IMPROVED WITH A PAVED OR CONCRETE SURFACE
BY A DATE NO LATER THAN SEVEN YEARS FROM THE DATE OF THIS
PASSAGE.
BE IT ORDAINED BY THE CITY COUNCIL AS FOLLOWS:
SECTION 1. The following hereby replaces Section XI, II, A, (2):
All parking areas, public or private, containing more than five (5) parking spaces
including open sales and storage areas shall be improved with an asphalt or concrete
surface. All existing public or private parking areas that contain five (5) or more parking
spaces shall be surfaced with an asphalt or concrete material. From the date of this
passage there will be a time period of seven(7) years allowed for property owners to
bring existing substandard parking areas that are not surfaced with asphalt or concrete
into compliance with these regulations.
SECTION 2. Validity of Regulations; If any section, clause or phrase of these regulations
shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of
these regulations as a whole or any part or provision thereof other than the part so
decided to be invalid or unconstitutional.
