v <br /> ORDINANCE NO. <br /> AN ORDINANCE SETTING THE TIMES WHEN THE CHILDREN'S PARK <br /> WITHIN RIVERSIDE PARK IN BATESVILLE, ARKANSAS, IS OPEN TO <br /> THE PUBLIC, DECLARING AN EMERGENCY, AND FOR OTHER PURPOSES. <br /> WHEREAS, the Children's Park within Riverside Park is designed for children to have a <br /> special place for recreation and special events such as birthday parties; and <br /> WHEREAS, this area is abused by vandalism and other acts which could endanger <br /> children and those with tt-eni, it is deemed necessary to take appropriate action. <br /> NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF <br /> BATESVILLE, ARKANSAS: <br /> SECTION 1. Hours of availability shall be from 7:00 A.M. to 9:00 P-M. during <br /> daylir-ht wing thtm <br /> SECTION 2. Hours of availability during other times shall be from 7:00 A-M. to 7.00 <br /> P.M. <br /> SECTION 3. For citations issued, the fine for non-compliance shall be not less than <br /> 5150.00 and not more than$300.00 for each occurrence plus cost. <br /> SECTION 4. The mayor shall have the authority to use discretion to allow other times as <br /> deemed necessary for special events such as parking, other reasonable events, etc. <br /> I <br /> SECTION 5. Appropriate signage shall be placed on site to advise as to the time <br /> when the Children' Park is open and closed. <br /> SECTION 5. EMERGENCY CLAUSE. Due to the fact that vandalism and other <br /> malicious acts are already present, an emergency is hereby declared to exist and this <br /> ordinance shall be in full force and effect from and after its passage for the public peace, <br /> health and safety. <br /> L( oe M.
