ORDINANCE NO.
AN ORDINANCE RE-ZONING PROPERTY OF SOUTHERLAND FARMS LLLP
FROM R-1 RESIDENTIAL TO COMMERCIAL C-1; DECLARING AN
EMERGENCY AND OTHER PURPOSES
BE IT ORDAINED BY THE CITY COUNCIL OF BATESVILLE, ARKANSAS AS
FOLLOWS:
(1) The following city property be and the same hereby is rezoned from R-I Residential
to Commercial C-1; said property presently owned by Southerland Farms LLLP
along with the Greenberg Farrow Architecture and Engineering Development
Company who is requesting the zoning classification change. The Batesville Planning
Commission conducted a public hearing on Monday, October 11, 2004 and has
recommended that the zoning classification be changed from R-1 to C-1.
(2) That the property is described thus:
Physical Address: 3000 Harrison Street
Legal description:
A tract of land being a part of the SE '/. of Section 15, T 13 N,
R 6 W, in the City of Batesville, Independence County,
Arkansas, more particularly described as follows:
Commencing at the southeast corner of said Section 15;
thence N 88°12'01" W along the south line of said Section 15,
991.74 feet to the point of beginning: thence continue N
88°12'01' W along the north line of Block 5 of Bryant's
Woodland Heights Addition, 830.07 feet to the southeast
comer of Lot 27 of Bryant's Second Eastern Addition; thence
N 02°42'51" E along the east line of said Bryant's Second
Eastern Addition, 133.25 feet to the southeast corner of Lot 28
of said Bryant's Second Eastern Addition, thence N 33000'28"
E, 88.72 feet; thence N 48053'02" W, 100.00 feet; thence S
32°18'04" W, 10.00 feet to the north line of said Lot 28; thence
N 48041'06" W, 140.38 feet to the southeast corner of the
Dombroski tract; thence along said Dombroski tract the
following: N 59052'40° E, 190.00 feet; N 79017'59" E, 161.70
feet; N 34022'25' E, 165.00 feet to the southwest comer of the
Jackson tract; thence along said Jackson tract the following: S
57030'18" E 116.09 feet; N 26021'00" E, 279.81 feet to the
southeast corner of the Batesville Utility Commission tract;
thence along said Batesville Utility Commission tract the
following: S 79041'55' E, 153.18 feet; N 01018'10" W, 178.07
feet to the south right of way line of Harrison Street; thence S
79°52'14" E along said south right of way line, 234.22 feet;
thence S 03°18'51" W, 944.51 feet to the point of beginning,
containing 14.0 acres, more or less.

(3) Emergency Clause-Due to the fact that construction is scheduled to begin in the near
future an emergency is hereby declared to exist and this ordinance shall be in full
force and effect from and after its passage.
