ORDINANCE NO. 2005-3—j
AN ORDINANCE WAIVING THE REQUIREMENTS OF COMPETITIVE
BIDDING DURING THE CALENDAR YEAR OF 2005 ON THE
PURCHASES OF ECOTECH ECO 634; DECLARING AN EMERGENCY
SAND FOR OTHER PURPOSES.

BE IT ORDAINED BY THE CITY OF BATESVILLE, ARKANSAS AS
FOLLOWS:
, SECTION 1 : That pursuant to Section Five (5) of Act 28 of 1959 as
i
i amended by Section One (1 ) of Act 154 of 1979, as codified in the
!Arkansas Statutes as Ark. Code Ann. Section 14-58-303 et seq., the
i
requirement of competitive bidding during the calendar year of 2005 is
hereby waived on the purchases of Ecotech Enterprises, Inc. ECO 634
water treatment coagulant and flocculent.
!SECTION 2: That the City Council finds this is an exceptional situation
I
warranting waiver of bidding due to the nonfeasibility and nonpracticality of
bidding because of the scarcity of suppliers of the product.
ISECTION 3: This ordinance shall be effective until December 31 ,
1 2005.

SECTION 4: EMERGENCY CLAUSE: These purchases would be in the
I
best interest of the public health, safety and welfare; that the timeliness of
the purchases is of the greatest importance to the continued water supply
i
of the City of Batesville and competitive bidding is not feasible nor practical,
and an emergency is hereby declared and this ordinance shall be in force
and effect as of the date of its passage.
