• ORDINANCE NO. 2005-9-1
AN ORDINANCE CALLING AN ELECTION ON THE LEVY OF AN
ADVERTISING AND PROMOTION TAX FOR THE PURPOSE OF TOURISM
WITHIN THE CITY OF BATESVILLE, ARKANSAS
WHEREAS, on the 14th day of June, 2005, the City Council of the City of
Batesville, passed Ordinance No. 2005-6-1 which imposed a 2% tax upon the
gross proceeds of hotel and motel accommodations, and a 1% tax upon the
gross proceeds of restaurants, cafes, and cafeterias and similar businesses
within the City of Batesville, Arkansas;
WHEREAS, a Petition for Referendum of said Ordinance has been filed
with the City Clerk of the City of Batesville, Arkansas, requesting that the issue
be placed before the legal voters of the City at a special election;
WHEREAS, the City has determined that said Petition of Referendum has
been signed by the requisite number of petitioners and that a special election
should be held on the issue of said tax.
• NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF BATESVILLE, ARKANSAS:
Section 1. There is hereby called an election by the registered voters of
the City of Batesville, Arkansas, as to whether or not they wish to adopt a
2% tax upon the gross proceeds of hotel and motel accommodations and
a 1% tax upon the gross proceeds of restaurants, cafes, and cafeterias
and similar businesses as defined.
Section 2. The date of the election shall be November 8, 2005.
Section 3. By transmittal of a copy of this Ordinance by the City Clerk,
the County Board of Election Commissioners of Independence County are
hereby notified that the measure has been referred to a vote of the people,
and the election shall be conducted in accordance with all laws applicable
to municipal elections.
Section 4. By transmittal of a copy of this Ordinance by the City Clerk,
the County Board of Election Commissioners of Independence County is
hereby notified that the ballot title to be used in this election shall be as
follows:
• "FOR Adoption of a 2% tax upon the gross proceeds of hotel and
motel accommodations; and a 1% tax upon the gross proceeds of
restaurants, cafes and cafeterias and similar businesses as
defined, within the City of Batesville, Arkansas, for advertising and
promotion of the City and its environs."
"AGAINST Adoption of a 2% tax upon the gross proceeds of hotel
and motel accommodations; and a 1% tax upon the gross proceeds
of restaurants, cafes and cafeterias and similar business as
defined, within the City of Batesville, Arkansas, for advertising and
promotion of the City and its environs."
BE IT ORDAINED THIS 13TH DAY OF SEPTEMBER, 2005.
