AN ORDINANCE TO AMEND ORDINANCE NUMBER 986 OF 1982 TO ALLOW
THE USE OF "DRIVE OVER TYPE CURBS" IN CERTAIN RESIDENTIAL
SUBDIVISION APPLICATIONS.
WHEREAS, Ordinance Number 986 of 1982, allows for only one type of
curb to be used on all city streets whether they are major streets or minor streets,
and
WHEREAS, residential sub-division developers are under undue burden
because the current curb requirements, and
WHEREAS, the use of a "drive over" type curb will enhance the aesthetics
of residential sub-divisions by removing the need for driveway curb cuts each
time a home is constructed, and
WHEREAS, it is determined that the city's best interest will be served by
encouraging new residential sub-divisions.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF
BATESVILLE, ARKANSAS THAT ORDINANCE 986 OF 1982 IS HEREBY
AMENDED AS FOLLOWS:
Section 1 (B.) currently reads:
Directly adjacent to and connecting with each side of the traveled portion
of the street, there shall be a curb. The curb shall be constructed as follows:
each curb shall consist of a 6 inch concrete base. Each curb shall be 24 inches
in width. 18 inches of said curb width shall be consistent with the height of the
street and drop from the crown in the middle of the street to the edge of the street
side to allow for water drain off. The remaining 6 inches of said curb width shall
form a lip 6 inches in height greater than the above described curb surface and
12 inches in height from said base.
Section 1 (B.) is hereby amended to read as follows.-
(a.)

required curb shall be as follows.

Further, The Planning Commission of the City of Batesville may require
curbs on some streets in residential subdivisions to be built to the standard of (a)
above because of drainage or traffic concerns.
Section 1 (C.) currently reads:
That attached hereto and marked EXHIBIT "A" and made a part of this
Ordinance as though set out herein in full, word for word, item for item, is a
diagram of the method of construction which must be adhered to.
Section 1 (C.) is hereby amended to read as follows:
That attached hereto and marked AMENDED EXHIBIT "A" and made a
part of this Ordinance as though set out herein in full, word for word, item for
item, is a diagram of the method of construction for "a" and "b" above which must
be adhered to.
It is hereby found by the City Council that in order to promote continued
residential growth an emergency is hereby declared and this Ordinance shall be
in full force and effect from and after the date of its passage and approval.
