BEFORE THE CITY COUNCIL
OF THE CITY OF BATESVILLE, ARKANSAS
AN ORDINANCE REZONING CERTAIN PROPERTY OF SCOTT CLARK AND
MAX McELMURRY FROM R-1 TO R-2 IN NORTH PARK SUBDIVISION, AND
FROM R-1 TO C-2 IN AJACENT PROPERTY AS SHOWN ON ATTACHED
EXHIBIT MAP.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF BATESVILLE,
ARKANSAS AS FOLLOWS:
1. The legally described property below be rezoned from R-1 to R-2 and C-2
respectively, said property being located within the City Limits of the City of
Batesville, Arkansas.
a. ZONED FROM R-1 TO R-2
Legal Description:
Lots 17 through 23 inclusive, of the North Park Addition to the City of
Batesville, Arkansas.
b. ZONED FROM R-1 TO C-2
Legal Description:
A tract of land being a part of the NWi/4 of Section 9. T 13 N. R 6 W in the
City of Batesville, Independence County, Arkansas, more particularly described
as follows:
commencing at the southwest corner of said NWi/4;
thence N 03'16' 10' W along the west line of said NWi/4, 1732.24 feet:
thence N 86'43'50" E. 52.0 feet to the east right of way line of North Park Road
and the point of beginning:
thence N 03'i6' SOW" 451.48 feet to the south right of way line of White Drive:
thence along said right of way line the following:
N 03'16' 10" W, 468.75 feet:
along a curve to the right, said curve having a radius of 905.0 feet, an arc length
of 568.63 feet. a long chord bearing of N 67'48' 16" E and a long chord
distance of 559.32 feet:
N 89'47'56" E. 143.55 feet.
N 85'48'41" E. 270.56 feet to the centerline of Poke Bayou:
thence along said centerline the following:
S 13'30' W. 450.0 feet:
S 04'53'42' E. 328.58 feet.
S 07'48'S7" E. 284.85 feet:
S 03-06-49- E. 159/63 feet;
S 29'22' 10" E. 1.99 feet to the northwest corner of Lot 49
of the North Park Addition to the City of Batesville. Arkansas:
thence S 83'18' 18- W. 725.41 feet to the northwest corner
of said Lot 49 and the east right of way line of Poke Bayou Loop:
thence along said east right of way line the following:
beginning on a tangent of N 03'16'10" W. along a curve to the
right, said curve having a radius of 68.77 feet and an arc length of 54.01 feet:
N E. 118.93 feet:
alongong a a cur curve to the left, said curve having a radius of 97.43 feet and an
arc length of 76.52 feet to the north line of said North Park Addition:
thence S 86'43'50" W along said north line, 50.0 feet to the west
right of way line of said Poke Bayou Loop and the west line of Lot 20 of said
North Park Addition:
thence N 03'16' 10" W along said west right of way line, 137.85 feet.-
thence S 86'43'50" W. 580.77 feet to the point of beginning.
This tract contains 26.72 acres, more or less.

2. The Batesville Planning Commission has recommended that the above
described property b'e/zoned as set forth above.
