Whereas, the Board of Commissioners of the Batesville Water Utilities,
Batesville, Arkansas, has opportunity to purchase a portion of the Rockmoore Water
Association system lying within the city limits of Batesville; and
Whereas,the acquisition area is in three parcels; The first area beginning at the
current location of the Rockmoore master meter at Eagle Mountain Boulevard lying south
of Arkansas Highway 69 and south and west of Arkansas Highway 394 continuing east to
the Batesville City limits minus a 200 foot offset on the south side of 394 beginning at
the curve just east of Liberty Lane and continuing to the Batesville City limits; and
Whereas,the second being an area beginning at the current Batesville city limits
and lying east and south of the city limits known as Eagle Mountain Development
properties as is described in deed book N-16, page 493, of the Independence County
Records (a legal document on file at the Independence County Court House) and subject
to the following conditions:
• The Rock-Moore Water Association retains service rights to the 200' offset as
prescribed above subject to future agreements between the Rock-Moore Water
Association and the Batesville Water Utilities Commission.
• The Rock-Moore Water Association retains the right to offer water service to the
developer of Eagle Mountain Properties subject to the following constraints:
1. The period of service will not extend beyond a period of five years from the date
of this agreement unless otherwise requested by the Batesville Water Utilities
Commission.
2. The installation of such water service must meet Batesville Water Utilities'
standards.
3. Rock-Moore Water Association will retain all revenue provided by customers on
Rock-Moore lines in the development until such time as Batesville Water Utilities
extends service to the development at such time Rock-Moore will transfer all
customers to Batesville Water Utilities without cost.
Whereas, the third area lying north of Arkansas Highway 69 east bordered by the
Saw Mill addition, the Batesville City limits, Highway 69 and the railroad tracks; and
Whereas,the Rockmoore Water Association desires to sell this portion of their
system to the Batesville Water Utilities for $300,000.00 and the construction of certain
water lines; and
Whereas, the Batesville Water Utilities Commission considers this an equitable
price; and

Whereas, part of the area on the north side of Highway 69 has limited water
volume and pressure requiring better fire protection; and
Whereas, Batesville Water Utilities desires to finance the purchase with bonds;
and
Whereas,the Batesville City Council must approve this purchase; and,
Whereas,the City of Batesville must be the principal party on the bonds,
Now therefore,be it resolved by the City Council of the City of Batesville that the
Board of Commissioners of the Batesville Water Utilities should proceed with the above
described purchase.
