�w <br /> • <br /> RESOLUTION NO. <br /> A RESOLUTION AUTHORIZING THE SALE OF CERTAIN REAL PROPERTY <br /> TO WHITE RIVER PETROLEUM COMPANY, INC. AND FOR OTHER <br /> PURPOSES <br /> WHEREAS, The City of Batesville is the owner of a tract of land that presently has no <br /> public or governmental use or purpose; and <br /> WHEREAS, said tract of land will have no public or governmental use in the foreseeable <br /> future; and <br /> WHEREAS, White River Petroleum Company, Inc. has expressed a desire to purchase <br /> said land from the City of Batesville for $25,600.00 which includes the fair market value <br /> as determined by appraisal, the cost for survey and cost for appraisal; and <br /> WHEREAS, the city is desirous of accepting the offer of White River Petroleum <br /> Company, Inc.; and <br /> WHEREAS, the city is granted the authority to sell unused property under Arkansas <br /> Code Annotated 14-54-302; <br /> NOW, THEREFORE BE IT RESOLVED that the mayor is authorized to execute any <br /> contracts or conveyances necessary to convey the following described property to <br /> White River Petroleum Company, Inc. <br /> A tract of land being a part of Lot 2 and a part of Lot 3 of Block 3 of the Cottonyara Aaaition <br /> to the City of Batesville. Independence County, Arkansas, more particularly described as follows: <br /> commencing at the southeast corner of said Lot 3: <br /> thence N 89'04'54" W along the south line of said Lot 3, 88. 14 feet to the point of beginning; <br /> thence continue N 89104'54" N along said south line. 143.86 feet to the most southerly <br /> southwest corner of said Lot 3; <br /> thence N 38'19'54" W along the south and west line of said Lot 3, 28.81 feet to the most <br /> westerlyy southwest corner of said Lot 3; <br /> thence N 02'35'05" E alon the west line of said Lot 3 and said Lot 2, 121.39 feet to the <br /> southwest corner of the S�ms tract as shown on asurvey by Burton Arnold (dated 11/04/65); <br /> thence S 89'04'51" E along the south line of said Sims tract 249.14 feet: <br /> thence S 01 '53'30" N, 57.0 feet to the south line of said Lot 2; <br /> thence N 89'04'54" W along the north line of said Lot 3, 88.14 feet: <br /> thence S 01 '53'30" W. 86.67 feet to the point of beginning. <br /> This tract contains 0.64 acres, more or less. and is subject to any and all easements. <br /> Be it further resolved that the City of Batesville accepts $25,600.00 with said sum <br /> representing the fair market value and associated costs for the subject property from <br /> White River Petroleum Company, Inc. <br /> IT IS SO RESOLVED this-,-)- r�day of January, 2003. <br /> )Jo�%�iard, Mayor <br /> ATTEST: <br /> lot),\.c <br /> Denise Jofmton,CWy Clerk <br />
