RESOLUTION NO. /yrl��
CITY OF BATESVILLE ARKANSAS
WHEREAS, the Batesville Utilities Commission an agency of the City of Batesville,
Arkansas, is charged with the duty to construct, reconstruct, build, maintain, and repair the water
and sewer treatment plants, distribution system, and collection systems of the City of Batesville
Arkansas; and
WHEREAS, the City of Batesville, Arkansas, has acquired by donation title to lands from
Lyon College of Batesville Arkansas,predecessor in interest to the Eagle Mountain Properties
L.L.C.; and
WHEREAS, donation of lands for public use for the water and sewer system contributes
significantly to reduction in the cost of construction and the City of Batesville wishes to
encourage donors to make such donations for public use; and,
t` WHEREAS, the return to the grantors of these parcels after the need of public use has
fir► ended, subject to easements for existing water or sewer lines, would encourage donors to donate
such sites to public use;
NOW, therefore, be it resolved by the City of Batesville, Arkansas:
1. That the lands lying in Independence County, Arkansas described as follows:
A tract of land being a part of the SW 1/4, SW 1/4 and a part of the
NW 1/4, SW 1/4 and a part of the NE 1/4 in Section 14, T 13 N„
R 6 W in Independence County, Arkansas, more particularly described as
follows:
commencing at the southwest corner of said Section 14,
thence N 01° 59'40" E, 507.92 feet;
thence S 88° 00'20" E, 355.22 feet to the east right of way line of
Eagle Mountain Boulevard and the point of beginning;
thence along said east right of way line the following;
N 040 37'19" E, 236.50 feet;
along a curve to the left said curve having a long chord bearing of
N 20° 55' 26" W, a long chord distance of 473.78 feet;
N 470 13' 26" W, 138.26 feet to the south right of way line of
Harrison Street;
thence N 30° 10' 56" E along said south right of way line, 587.46 feet
to the southwest corner of the Ed Ward tract;
thence along said Ed Ward tract the following:

SUBJECT TO A RESERVATION OF SEWER
EASMENT FIFTEEN FEET(15') WIDTH, 7.5
FEET ON EACH SIDE OF A SEWER
PIPE IN PLACE ACROSS SAID LANDS.
which were donated to the City of Batesville, Arkansas for use as a sewer pump station
site by Lyon College and Aberdeen Development Corporation., shall be returned to the
successor and interest Eagle Mountain Properties, L.L.C. by Warranty Deed, and the
Mayor and City Clerk are authorized an directed to execute the conveyance on behalf of i

the city.
2. That the City of Batesville, Arkansas+ke place in its minutes a copy of this
resolution to evidence its thanks and gratitude to Arkansas College, predecessor and interest to
Lyon College, and its wholly owned subsidiary Aberdeen Development corporation, and to
Eagle Mountain Properties, L.L.C., for their contribution to the public health and welfare of the
citizens of Batesville by the grant of these lands and equipment for public use.
This resolution was passed by the Batesville City Counsel by vote of for and
against on this day of 2003.

That the City of Batesville, Arkansas, by and through its mayor, Joe Baird, and
its City Clerk, Denise Johnston, dully elected and serving, pursuant to Batesville
City Ordinance number 99-12-2, and duly authorized by the Batesville City
Counsel as requested by the Batesville Utility Commission in its September 23
2003 resolution, and in consideration of the sum of one dollar ($1.00) and other

RESOLUTION NO. 03-09-01 OF THE BATESVILLE

WHEREAS, the Batesville Utilities Commission, an agency of the City of
Batesville, charged with the duty and authority to construct, reconstruct, build, maintain,
and repair the water and sewer treatment plants, distribution and collection systems for
the City of Batesville, Independence County, Arkansas, has acquired the use of lands
from Lyon College, from its wholly owned subsidiary Aberdeen Development
Corporation, predecessor in interest to Eagle Mountain Properties L.L.C.;
WHEREAS, the Batesville Utilities Commission is from time to time donated sites
or easements or both for public use for the water and sewer system at no cost or nominal
cost, and these donations contribute significantly to reduction in costs of construction and
(W the Batesville Utility Commission wishes to encourage donors to make such donations
for public use; and
WHEREAS, the return to the grantors of these parcels, subject to easements for
existing water or sewer lines, after the need for public use has ended, would encourage
donors to donate such sights to public use;
NOW, THEREFORE, be it resolved by the Batesville Utilities Commission;
1. That a sewer pump station site upon a tract of land lying in
Independence County, Arkansas, described as follows:
A tract of land being a part of the SW I/4, SW 1/4 and a part of the
NW 1/4, SW 1/4 and a part of the NE 1/4 in Section 14, T 13 N„
R 6 W in Independence County, Arkansas, more particularly described as
follows:
commencing at the southwest comer of said Section 14,

conveyance of which has been lost or misplaced, which site is no longer
needed for public use, but should be reconveyed, subject to a reservation of a
fifteen foot (15) wide easement for sewer lines in place across said lands.
To Eagle Mountain Properties, L.L.C. successor in interest to
Lyon College and Aberdeen Development Corporation, with the thanks and
gratitude of the City of Batesville for use of the pump station site.
2. The pump station site has upon it a structure housing
certain pumps and electrical controls, which were also contributed to the City
of Batesville by Lyon College and its wholly owed subsidiary, Aberdeen
Development Corporation, and this equipment
P rp is no longer needed for public
use, and should be reconveyed to Eagle Mountain Properties L.L.C. The
successor and interest to Lyon College and Aberdeen Development
Corporation upon the agreement that the Batesville Utilities Commission
shall be notified when the equipment is dismantled or moved, and shall have
the right to have a representative present during the dismantlement of the
equipment in order to insure the integrity of the sewer line. Following
dismantlement Batesville Utilities Commission will plug the old lines and fill
the old wet well with gravel.
3. That the Batesville Utilities Commission shall place in its
minutes a copy of this resolution to evidence its thanks and

Minutes a copy of this resolution to evidence its thanks and gratitude to
First National Bank and Bank of America for their contribution to the

Baird, and its City Clerk, Denise Johnston, duly elected and serving, pursuant to
Batesville City Ordinance No. 99-12-2, and duly authorized by the Batesville
City Council as requested by the Batesville Utility Commission in its September

to evidence its thanks and gratitude to First National Bank of Batesville, Arkansas and to the
Bank of America for their contribution to the public health and welfare of the Batesville and its j
