RESOLUTION NUMBER:
A RESOLUTION CONDEMNING THE STRUCTURE DESCRIBED
HEREIN, DECLARING A NUISANCE AND FOR OTHER PURPOSES.
WHEREAS, Section 11.12.01 et seq of the Batesville Municipal Code provides for
condemnation of buildings, houses, and other structures under certain circumstances and;
WHEREAS, the building described herein has been examined by the City Council and
Code Enforcement Officer because of the disrepair of the structure, and;
WHEREAS, the structure has the following deficiencies:
1. Major structural components, or parts thereof, such as the doors, windows,
and walls are missing or damaged;
2. The structure has been left unlocked, unattended, and vacant;
3. The structure is not under active repair;
4. The structure is not being used as an accessory building or out building;
• WHEREAS, the property is located at 394 Pine Street and owned by HSBC Mortgage
Services and or David and Jeanette Hobson constitutes a hazard and nuisance for the
reasons set out above.
NOW BE IT RESOLVED, that the owner of said property was notified or attempted
to be notified at least twenty(20)days prior to the public hearing as provided in Section
11.12.03 and 11.12.04 of the Batesville Municipal Code.
BE IT FURTHER RESOLVED that if the building and or structure constituting a
nuisance has not been torn down and removed or said nuisance otherwise abated within
thirty(30) days after posting the true copy of the resolution at a conspicuous place on
said house,building, and or structure constituting the nuisance, it will be torn down and
or removed by the Code Enforcement Officer or his duly designated representative at the
discretion of the City Council as provided in Section 11.12.05 of the Batesville Municipal
Code.

Mr. Hobson,
Please be advised that a public hearing before the City Council of Batesville will be held on Tuesday,June
9,2009 at the Municipal Building at 5:30 P.M.to consider the condemnation of the structure located at 394
Pine St., according to the tax records, parcel#1 10131 1000 you are shown as the owner of record.
The structure is and has been in violation of city ordinance#90-8=1 (attached),which is considered a
!` nuisance and potential risk to the health and safety of the community.
�r If the structure is condemned by the city council then a time will be given to demolish and remove the
structure or the city will have it done and you will be liable for any expenses involved. Please make
arrangements to be in attendance at this meeting and if you have any questions you may contact me at 870-

The City of Batesville is about to begin Condemnation Proceedings on the above
referenced property. I understand that the property has been released from the Automatic Stay
issued by the United States Bankruptcy Court Eastern District of Arkansas,Batesville Division
case number 1:06-13068 E/C.
I was hoping that you could advise as to who the real owner in interest is so that we might
properly notify that party of the Condemnation Proceeding. Obviously,the trail that the
Batesville Code Enforcement Officer has followed ends with your client, HSBC Mortgage
Services. Any insight as to the real owner in interest will be greatly appreciated.
I appreciate your cooperation and attention in this matter and if you need anymore

Our office is in receipt of your letter dated 04/07/2009 in connection with the notification that the
City of Batesville is about to begin a process of condemning the property above. We have
notified HSBC Mortgage with respect to your letter, however, until this property is sold by the
Hobson's or transfer of deed by virtue of foreclosure is taken this property belongs to the
Hobson's, with the financial interest of our client. You may have the notice sent to HSBC
MORTGAGE SERVICES, 636 GRAND REGENCY BLVD., BRANDON , FL 33510 , and the
notice will need to be sent to the owner's, David & Jeanette Hobson. We do not have any
current information on the borrowers. Thank you for your time.

• On Tuesday,June 9,2009 the Batesville City Council will conduct a Public Hearing to consider the
condemnation of the following structures:

3. 401 West Main Street:Norman L. Barnett
The hearing will be conducted at city hall at 5:30 PM. For additional information call 698-2456.
PUBLIC HEARING
On Wednesday,June 20,2009 the Batesville Planning Commission will conduct a public hearing to
consider a Conditional Use Permit for a Tropical Snow Trailer to be located at 1190 St. Louis Street.Time
to be determined,call city hall for additional information 698-2400.

DEFINITIONS

(A) "Security Instrument" means this document, which is dated October 28, 2004
together with all Riders to this document.

(E) "Note" means the promissory note signed by Borrower and dated October 28, 2004
The Note states that Borrower owes Lender ninety-four thousand eight hundred
seventy-five and 00/100 Dollars
(U.S. $94,875.00 ) plus interest. Borrower has promised to pay this debt in regular Periodic
Payments and to pay the debt in full not later than November 2, 2034
(I) 'Property" means the property that is described below under the heading "Transfer of Rights in the
Property."
(G) "Loan" means the debt evidenced by the Note, plus interest, any prepayment charges and late charges
due under the Note, and all sums due under this Security Instrument, plus interest.
(H) "Riders" means all Riders to this Security Instrument that are executed by Borrower. The following
Riders are to be executed by Borrower [check box as applicable]:

(I) "Applicable Law" means all controlling applicable federal, state and local statutes, regulations,
ordinances and administrative rules and orders (that have the effect of law) as well as all applicable final,
non-appealable judicial opinions.
(.1() "Community Association Dues, Fees, and Assessments"means all dues, fees, assessments and other
charges that are imposed on Borrower or the Property by a condominium association, homeowners
association or similar organization.
(K) "Electronic Funds Transfer" means any transfer of funds, other than a transaction originated by
check, draft, or similar paper instrument, which is initiated through an electronic terminal, telephonic
instrument. computer, or magnetic tape so as to order, instruct, or authorize a financial institution to debit
or credit an account. Such term includes, but is not limited to, point-of-sale transfers, automated teller
machine transactions, transfers initiated by telephone, wire transfers, and automated clearinghouse
transfers.
(L) "Escrow Items"means those items that are described in Section 3.
(M) "Miscellaneous Proceeds"means an)' compensation, settlement, award of damages, or proceeds paid
by any third party (other than insurance proceeds paid under the coverages described in Section 5) for: (i)
damage to, or destruction of, the Property; (ii) condemnation or other taking of all or any part of the
Property; (iii) conveyance in lieu of condemnation; or (iv) misrepresentations of, or omissions as to, the
value and/or condition of the Property. -
(N) "Mortgage Insurance" means insurance protecting Lender against the nonpayment of, or default on,
the Loan.
(0) 'Periodic Payment" means the regularly scheduled amount due for (i) principal and interest under the
Note, plus(ii) any amounts under Section 3 of this Security Instrument.
(P) "RESPA" means the Real Estate Settlement Procedures Act (12 U.S.C. Section 2601 et seq.) and its
implementing regulation, Regulation X (24 C.F.R. Part 3500), as they might be amended from time to
time, or any additional or successor legislation or regulation that governs the same subject matter. As used
in this Security Instrument, "RESPA" refers to all requirements and restrictions that are imposed in regard
to a "federally related mortgage loan" even if the Loan does not qualify as a "federally related mortgage
loan" under RESPA.
(Q) "Successor in Interest of Borrower" means any party that has taken title to the Property, whether or
not that party has assumed Borrower's obligations under the:Mote and/or this Security Instrument.
