AUGUST 26, 2014
The Batesville City Council met in regular session on August 26th at 5:30 P.M. at
the Municipal Building. Mayor Rick Elumbaugh called the meeting to order. Utility
Billing Supervisor Nick Baxter gave the invocation. Upon roll call, the following
councilmembers answered present: Chris Beller, Tommy Bryant, Paige Hubbard, Doug
Matthews, Chris Poole and David Shetron. Also present were the City Attorney Lindsey
Castleberry and City Clerk Denise Johnston. Councilmembers Fred Krug and Margarett
Henley were absent.
Councilmember Shetron moved to approve the minutes from the previous
meeting. Councilmember Beller seconded and all voted for.
Councilmember Bryant moved to approve the prepared agenda. Councilmember
Beller seconded and all voted for.

NEW BUSINESS
A) HEAR A REQUEST FROM A CITIZEN REGARDING REPAIR FROM DAMAGES
INCURRED ON 20TH STREET
Mr. Don Reed addressed the council regarding damages he received to his
vehicle after hitting a rock on 20th Street. According to Mr. Reed, the rock fell
from the truck of one of the sub-contractors working on the Community Center/
Aquatics Park on 20th Street. Parks Director Jeff Owens said he went to the
scene of the accident and advised Mr. Reed to put in a claim with the General
Contractors insurance company. Mr. Reed said he visited with the General
Contractor who said he was not responsible for his subs, however, Mr. Reed
received a phone call from the contractor's insurance company questioning him
about the incident. City Attorney Lindsey Castleberry, reminded the council that
the City has tort immunity and is not required to pay for damages.
Councilmember Shetron told Mr. Reed that he should have his attorney send the
General Contractor a letter and persue that course of action.
B) REVIEW FINANCIALS
The council was given a copy of the July 31, 2014 financials for review.
MAYOR COMMENTS
Mayor Elumbaugh said the state aid street projects will be beginning soon. He
also said the street department is going to have to close Chaney Drive again for a
couple of days next week to complete the work on the bridge.
Parks Director Jeff Owens addressed the council with a slide presentation
showing the corrections being made at the soccer fields (at the contractor's expense)
and the progress at the Community Center/Aquatics Park. Mr. Owens said because of
the extremely wet spring and summer, the project is a little behind schedule but he is
still hoping to be completed by September, 2015.
Fire Chief Brent Gleghorn addressed the council with a repair request for a 1996
Pumper truck for the Fire Department. The Chief said the engine needs repaired and
the bid he received from Emergency Repairs of Arkansas was $18,308.99. He said
other than the engine the truck was in good condition. Councilmember Shetron asked if
he had requested any other bids or had anyone else look at the truck. Chief Gleghorn
said he had not but would be glad to do so. The council agreed that a second opinion
would be appropriate.
The Chief also said the notice to proceed had been given to M & A Jones
Construction for the new Fire Training Center to be constructed at UACCB. Also, the
plans for the new fire station at the Airport were almost ready and he hoped to be able
to present them at the next Airport Commission meeting.
Mayor Elumbaugh said the City received two bids on the converting to LED
lighting in the Municipal Building. The council reviewed the bids and asked the Mayor to
get more specific information on both. Councilmember Shetron moved to authorize the
Mayor to get additional information on the bids and accept the one he believes is the
best for the City. Councilmember Poole seconded and all voted for.
LIAISON REPORTS
Councilmember Bryant said the Airport Commission was given a walk-through of
the new 6 bay airplane hangar. He said they are going through the punch list with the
contractor and a ribbon cutting ceremony will be planned soon.
COUNCIL COMMENTS
Councilmember Shetron asked for an updated financial as soon as the street
corrections were made.
