HomeMy WebLinkAbout2014-08-25-SPECIAL MEETING MINUTES OF COUNCIL AUGUST 25, 201 The Batesville City Council met in Special Session on August 25th at 5:30 P.M. at the University of Arkansas Community College in Batesville's Independence Hall. Mayor Rick Elumbaugh called the meeting to order. Cemetery / Landscaping Supervisor Jonathan Abbott gave the invocation. Upon roll call, the following councilmembers answered present: Chris Beller, Tommy Bryant, Margarett Henley, Paige Hubbard, Doug Matthews, Chris Poole and David Shetron. Also present were the City Attorney Lindsey Castleberry and City Clerk Denise Johnston. Councilmember Fred Krug was absent. Mr. Don Zimmerman with the Arkansas Municipal League was also present. Councilmember Bryant moved to approve the prepared agenda. Councilmember Henley seconded and all voted for. NEW BUSINESS A) CONSIDER AN ORDINANCE CALLING AN ELECTION TO SUBMIT TO THE VOTERS OF BATESVILLE AND OTHER AFFECTED CITIZENS THE QUESTION OF ANNEXATION OF CERTAIN LANDS SOUTH OF WHITE RIVER Mayor Elumbaugh introduced Mr. Don Zimmerman, Executive Director for the Arkansas Municipal League. The Mayor said Mr. Zimmerman is an expert in Municipal Law and is here to help answer questions throughout the meeting. Mr. Zimmerman gave a few brief remarks on the process of annexation. Mayor Elumbaugh then gave a few remarks on when the proposed annexation process began and his vision for the community. At that time, the Mayor opened the floor for comments from the audience. After a lengthy discussion, the Mayor put the question at hand to the council. Councilmember Bryant introduced the ordinance. Councilmember Bryant moved to suspend the rules and read the ordinance by title only. Councilmember Hubbard seconded. The roll call vote was 4 for (Beller, Bryant, Henley and Hubbard) and 3 against (Matthews, Poole and Shetron). The motion failing, Mr. Castleberry read the ordinance in full. The Mayor opened the floor for council comments. There being none, Councilmember Bryant moved to further suspend the rules and waive the second and third readings. Councilmember Henley seconded and the roll call vote was 6 for and 1 (Matthews) against. Motion carried. Councilmember Bryant moved to adopt the ordinance. Councilmember Henley seconded. The roll call vote was 5 for (Beller, Bryant, Henley, Hubbard and Shetron) and 2 (Matthews and Poole) against. With 6 votes needed to pass the ordinance, Mr. Zimmerman said State law ACA 14-43-501 authorizes the Mayor to vote if his vote is needed to pass an ordinance. Mayor Elumbaugh voted yes, therefore the motion passed, 6-2. The ordinance was given #2014-08-01. ADJOURNMENT There being no further business, Councilmember Bryant moved that the meeting be adjourned. Councilmember Beller seconded and all voted for. RICK ELUMBAUGH, MAYOR DENISE M.
