BEFORE THE CITY COUNCIL
OF THE CITY OF BATESVILLE, ARKANSAS
A RESOLUTION AUTHORIZING THE MAYOR OF THE
CITY OF BATESVILLE TO EXECUTE A WARRANTY DEED
IN FAVOR OF THE ARKANSAS STATE HIGHWAY COMMISSION,
AND FOR OTHER PURPOSES.
WHEREAS, the Arkansas State Highway Commission has offered
to purchase certain property owned by the City of Batesville for
the purpose of widening and improving State Highway No . 69; and
WHEREAS, it has been determined by the City Council that it
is in the best interest of the City of Batesville and the State
of Arkansas to convey the tract of land to the State Highway
Commission; now
BE IT THEREFORE RESOLVED, that the Mayor of the City of
Batesville is authorized to execute a Warranty Deed in favor of
the Arkansas State Highway Commission conveying the tract of land
described in the proposed Warranty Deed attached hereto and
incorporated herein by reference for the considerations stated
therein.

WARRANTY DEED
KNOW ALL MEN BY THESE PRESENTS :
THAT City of Batesville, Arkansas
for and in consideration of the Sum of FOUR HUNDRED TWENTY
FIVE AND N0/100 dollars, ($425 . 00
and other good and valuable consideration, cash in hand paid by
the Arkansas State Highway Commission, the receipt of which is
hereby acknowledged, hereby grant, bargain, sell and convey unto
the Arkansas State Highway Commission, and unto its successors
and assigns forever the following lands, save and except such
minerals therein and thereunder, as oil, gas , distillate, con-
densate, salt water and its component parts, and all other hydro-
carbons which do not interfere with the surface use for highway
purposes, lying and being situated in the County of Independence ,
State of Arkansas , to-wit:
Part of the Northeast Quarter of the Southwest Quarter of Section 13,
Township 13 North, Range 6 West, also being part of Block 13, Wolford's
Quail Valley East Subdivision, Independence County, Arkansas, more
particularly described as follows:
Starting at the Southeast Corner of Lot 1, Block 13, Wolford's Quail
Valley East Subdivision; thence North 22° 10' 11" West along the East
line of Lot 1, Block 13, Wolford' s Quail Valley East Subdivision a
distance of 149.23 feet to a point on the Southerly existing right of
way line of State Highway 69; thence North 69° 02' 57" East along said
existing right of way line a distance of 264.59 feet to a point; thence
South 20° 57' 03" East along said existing right of way line a distance
of 10.00 feet to a point; thence in an Easterly direction along said
existing right of way line on a curve to the right having a radius of
1859.86 feet a distance of 105.82 feet for the point of beginning; thence
continue in an Easterly direction along the Southerly existing right
of way line of State Highway 69 on a curve to the right having a radius
of 1859.86 feet a distance of 104.66 feet to a point on the East line
of the Northeast Quarter of the Southwest Quarter of Section 13; thence
South 020 26' 49" West along the East line of the Northeast Quarter

TO HAVE AND TO HOLD the same unto the said Arkansas
State Highway Commission and unto its successors and assigns
forever.
And the City of Batesville hereby covenants with
the said Arkansas State Highway Commission that the City of
Batesville will forever warrant and defend the title
to said lands and property against the lawful claims of any and
all persons whomsoever.
IN WITNESS WHEREOF, the City of Batesville Arkansas

their respective capacities to execute the foregoing instrument
for and in the name and on the behalf of said Municipal Corporation,
and further stated and acknowledged that they had so signed, executed
and delivered said foregoing instrument for the consideration, uses
and purposes therein mentioned and set forth. ,
