RESOLUTION NO 92-6-1
BEFORE THE CITY COUNCIL
OF THE CITY OF BATESVILLE, ARKANSAS
A RESOLUTION AUTHORiZING THE CITY ATTORNEY TO
INITIATE A LAWSUIT SEEKING A JUDICIAL DECLARATION THAT
THE PROPERTY COMMONLY KNOWN AS THE MARVIN HOTEL PROPERTY
CONSTITUTES A NUISANCE, AND FOR OTHER PURPOSES
WHEREAS, a structure located within the city limits of Batesville,
Arkansas known as the Marvin Hotel has been in a state of despair and
structurally unsound for an extended period of time; and
WHEREAS, various citizens have expressed concern that the structure
is a hazard to the public health, safety and welfare of the citizens of `
Batesville; and
WHEREAS, Section 11.3609 of the Batesville Municipal Code provides that
the City may initiate legal action for a judicial determination that certain
structures may be declared a nuisance; now
• BE IT THEREFORE RESOLVED:
1. That the City Attorney is hereby authorized to bring an action in
the appropriate court for the purpose of judicially declaring the structure
known as the Marvin Hotel in Batesville, Arkansas to be a nuisance, and to
bring said suit for that purpose and in the name of the City of Batesville.
BE IT FURTHER RESOLVED, that the City Attorney shall be authorized,
in the event the said structure is declared to be a nuisance, to pursue the
collection of fines and takes such other steps as may be necessary to abate
the nuisance that may be available under Arkansas Law or under the provisions
of the Batesville Municipal Code Sections 11.3-01 et sec . IT IS SO RESOLVED
this 9th day of June, 1992.
