BEFORE THE CITY COUNCIL
OF THE CITY OF BATESVILLE, ARKANSAS
A RESOLUTION URGING THE ARKANSAS DEPARTMENT OF POLLUTION
ECOLOGY, THE ARKANSAS ATTORNEY GENERAL AND THE POLLUTION
CONTROL AND ECOLOGY COMMISSION TO INVESTIGATE POTENTIAL
VIOLATIONS OF THE "ARKANSAS WATER AND AIR POLLUTION
CONTROL ACT" IN BATESVILLE, ARKANSAS ,
AND FOR OTHER PURPOSES
WHEREAS , Ark . Code Ann Section 8-4-101 et seg. , and
particularly Ark. Code Ann Section 8-4-303 prohibit "the presence
in the outdoor atmosphere of one or more contaminants in
quantities , of characteristics , and for a duration which are
materially injurious , or can reasonably be expected to become
materially injurious , to human, plant or animal life or to
property, or which unreasonably interfere with enjoyment of life
or use of property throughout the State or throughout the area of
the State as shall be affected thereby; " and
WHEREAS , the Department of Pollution Control and Ecology,
the Arkansas Pollution Control and Ecology Commission and the
Arkansas Attorney General have the authority , duty and obligation
under the various provisions of the "Arkansas Water and Air
Pollution Control ACC to investigate and remedy violations of
that act ; and
WHEREAS , there have been numerous complaints of air
pollution and air contamination which appears to emanate from the
Townsends of Arkansas operation in Batesville , Arkansas ; and
WHEREAS , the City of Batesville is gravely concerned that
there may be violations of the "Arkansas Air and Water Pollution
w
Act" which should be investigated and remedied under the
provisions of that act ; now
BE IT THEREFORE RESOLVED by the Batesville City Council that
the Arkansas Department of Pollution Control and Ecology, the
Arkansas Pollution Control and Ecology Commission and the Office
of the Attorney General of the State of Arkansas are urged to use
their full authority to investigate, and take whatever steps are
available under Arkansas Law to remedy, any violations of the
"Arkansas Water and Air Pollution Control Act" as described
herein.
The Batesville Municipal Clerk is directed to deliver copies
of this resolution to the Arkansas Pollution Control and Ecology
Commission, the Director of the Arkansas Department of Pollution
Control and Ecology and the Honorable Winston Bryant , Attorney
General for the State of Arkansas .
