HomeMy WebLinkAbout2015-05-26 MINUTES OF COUNCIL MAY 26, 2015 The Batesville City Council met in regular session on May 26, at 5:00 P.M. at the Municipal Building. Mayor Rick Elumbaugh called the meeting to order. Utility Billing Supervisor Nick Baxter gave the invocation. Upon roll call, the following councilmembers answered present; Chris Beller, Tommy Bryant, Margarett Henley, Paige Hubbard, Doug Matthews, Chris Poole and David Shetron. Also present were the City Attorney Lindsey Castleberry and City Clerk Denise Johnston. Councilmember Sonya Crafton was absent. Councilmember Bryant moved to approve the minutes from the previous meeting. Councilmember Henley seconded and all voted for. Councilmember Beller moved to approve the prepared agenda and Councilmember Bryant seconded. All voted for. CITIZENS COMMENTS None UNFINISHED BUSINESS None NEW BUSINESS A) CONSIDER ENTERING INTO A MANAGEMENT AND OPERATIONS AGREEMENT WITH MAIN STREET BATESVILLE CONCERNING THE BARNETT BUILDING PROPERTY Mr. Bob Carius with Main Street Batesville addressed the council to answer questions regarding the proposed Management and Operations Agreement between Main Street Batesville and the City regarding the responsibilities, obligations, and duties with respect to the management and operations of the Barnett Building. After a short discussion, Councilmember Matthews moved to approve the agreement and Councilmember Beller seconded. All voted for. B) ENGINEER'S REPORT City Engineer Damon Johnson addressed the council with his Engineer's Report. Mr. Johnson said not much has changed since the last meeting and asked the council if they had any questions for him. They discussed briefly the status of the Wastewater Treatment Plant improvements. Mr. Johnson said the project is about 90% complete but is still several months out from going live. MAYOR COMMENTS Mayor Elumbaugh asked City Attorney Lindsey Castleberry to address the council regarding a possible lawsuit. Mr. Castleberry said a delivery company damaged the carpet on the second floor when delivering a copy machine to one of our tenants. He said he has been dealing with the company for several months to try to negotiate a settlement for the damages. He said the company will not budge and they are about $1,000.00 off of the cost to replace the carpet. Mr. Castleberry said he would like to sue the delivery company in small claims court. Councilmember Bryant moved to proceed with the lawsuit and Councilmember Matthews seconded. All voted for. The Mayor invited everyone to attend his monthly Mayor's Meet and Greet scheduled for June 4t" from 5-6:30. The meeting will be held on the third floor, The Loft, of the Barnett Building. The Mayor said this season's first Movies in the Park was held this past weekend. Parks Director Jeff Owens said there were about 180 people in attendance. The Mayor also commented on the baseball tournaments held this past weekend. Thirty teams participated in the tournament with only one rainout. However, the large tournament with over 70 teams that was scheduled for week before last, was rained out. Mayor Elumbaugh invited everyone to the Ribbon Cutting Ceremony tomorrow at noon at the new Batesville Police Department. Tours of the facility will be available as well as hot dogs and drinks. The new Police Department will officially begin 6:00 AM on June 1St City Clerk Denise Johnston informed the council of a fixed asset disposal; a 2008 Ford F350, Unit 276 was traded in to Stanley Wood Chevrolet for a new 2015 Dodge one-ton truck. LIAISON REPORTS None COUNCIL COMMENTS Councilmember Henley said she has had a call regarding speeding on Sidney Street and asked Chief Cockrill if they could patrol the area. Councilmember Shetron said there are a couple of bad eyesores around town. The first is the old Caudle's Family Restaurant, formerly Western Sizzlin. The restaurant has been empty for several years and is in bad need of repair. The second location is at the intersection of Boswell and Broad Streets. There are several modular buildings that seem to be empty and are very unappealing to look at. ADJOURNMENT There being no further business, Councilmember Bryant moved that the meeting be adjourned.
