WHEREAS, Independence County has filed a petition to vacate and abandon
Bean Street in said petition, and;
WHEREAS, the Batesville City Council desires to hold a public hearing in order
to determine whether said petition should be granted and such an ordinance be
enacted.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
BATESVILLE, ARKANSAS, that the City Clerk is hereby directed to give notice
by publication once a week for two (2) consecutive weeks in the Batesville
Guard so that on the 27th day of August, 1996, a public hearing will be held in
City Hall, Batesville Municipal Building, at 7.00 PM, to determine whether said
petition should be granted and the requested ordinance enacted.
Adopted this 12th day of August, 1996.

PETITION OF INDEPENDENCE COUNTY ARKANSAS TO VACATE STREET
Comes Independence County, Arkansas, (hereinafter referred
to as Independence County) and for its Petition to Vacate
Street states as follows:
1. That it desires to vacate a certain portion of Bean
Street in Batesville, ArkansGs, and therefore petitions the
Batesville City Council to do so in accordance with the
provisions ACA 14-301-301 through 14-301-305 together with all.
other provisions applicable by law.
2 . That said street was platted in the early days of
Batesville and does not have substantial traffic. whatsoever.
3 . That Independence County is the record owner of
property abutting upon Bean Street between blocks 2 arid 3 of
the Old Town Addition to the City of Batesville, Arkansas;
that Independence County is asking the City of Batesville to
vacate that portion of Bean Street between Main Street and
College Avenue that lies between blocks 2 and 3 of the Old
Town Addition to the City of Batesville.
4 . A copy of the portion of the plat showing the street
to be vacated together with the blocks which abut upon the
street to be vacated is attached hereto.
5. WHEREFORE, Independence County, Arkansas, prays that
the Batesville City Council fix a date for hearing this
Petition, that it direct the city clerk to give notice by
publication in accordance with the requirements of ACA
14-301-303 and that upon hearing of this matter vacate this
above mentioned street.
