RESOLUTION NO. 97-6-1
RESOLUTION TO AUTHORIZE THE CITY COUNCIL
• AND THE MAYOR OF THE CITY OF BATESVILLE TO
ENTER INTO NEGOTIATIONS WITH INDEPENDENCE
COUNTY FOR AN INTERLOCAL AGREEMENT TO
FORM A LOCAL ELECTRIC UTILITY, AND FOR OTHER
PURPOSES
WHEREAS, the Batesville and Independence County Task Force for Lower
Electric Rates (the "Task Force") has diligently studied and pursued options for lower
electric rates for citizens of Batesville, and Independence County, and
WHEREAS, the Task Force has unanimously recommended that Batesville and
Independence County enter into negotiations for an interlocal agreement to form a local
electric utility and to concurrently conduct a feasibility study for the acquisition of the
Entergy electric distribution system in Independence County; and
WHEREAS, it is the desire of Batesville to pursue with Independence County
lower electric rates for its citizens, while at the same time provide reliable electric
service to its citizens.
NOW, THEREFOR, BE IT RESOLVED by the City Council of Batesville,
Arkansas that:
• Section 1. The City Council of Batesville, Arkansas, hereby authorizes the City Council
and the Mayor to enter into negotiations with Independence County for an interlocal
agreement to form a local electric utility.
Section 2. The interlocal agreement shall establish, define, and set out the composition,
functions, and powers, responsibilities, and duties of a local electric utility.
Section 3. Negotiations for said interlocal agreement shall be conducted concurrently
with an economic feasibility study to be undertaken by the County.
Section 4. It is the understanding and intention of the Batesville City Council that an
interlocal agreement to establish a local electric utility shall only be effective after
consideration and approval by respective ordinances of the City Council and the
Independence County Quorum Court.
Section 5. It is further understood by the Batesville City Council that nothing contained
herein shall obligate the City of county to establish a local electric utility and that
acquisition of Entergy's electric distribution system in Batesville and Independence
County can only be accomplished if it is economically feasible and after referendum by
the citizens of the City and County and approval by the Arkansas Public Service
Commission.
® Section 6. This Resolution shall be in full force and effect from and after its approval.
