A RESOLUTION CONDEMNING THE STRUCTURES DESCRIBED
HEREIN, DECLARING A NUISANCE AND FOR OTHER PURPOSES.
WHEREAS, Section 11.36.01, et seq of the Batesville Municipal Code
provides for condemnation of buildings, houses and other structures under certain
circumstances and; and
WHEREAS, the buildings described herein have been examined by the City
Council and Batesville Code Enforcement Officer because of the disrepair of the
structures, and;
WHEREAS, the structure has the following deficiencies:
1. Major structural components, or parts thereof, such as the
doors, windows and roof are missing;
2. The structure has been left unlocked, unattended and
vacant;
3. The structure does not appear to be under active
repair; and
4. The structure is not being used as an accessory
building or out building; and
WHEREAS, the property which is located at 450 Lilly Street within the
City of Batesville, Arkansas, more particularly described in the warranty deed
attached hereto and incorporated herein as Exhibit "A", said property being owned
by Habitat for Humanity of Greater Jonesboro, Inc. (the Commission of State
Lands of the State of Arkansas may also claim some interest in the described
property) constitutes a hazard and nuisance for the reasons set out above;

NOW BE IT THEREFORE RESOLVED that the Code Enforcement
Officer will notify the owner of said structure at least twenty (20) days prior to the
City Council Hearing as provided in Section 11.36.03 and 11.36.04 of the
Batesville Municipal Code.
BE IT FURTHER RESOLVED that the Batesville City Clerk will set the
matter for public hearing at 5:30 P.M., Maya ' 1998 at the Batesville Municipal
Building Hearing Room, 500 East Main Street, Batesville, Arkansas.

good and valuable consideration paid by Habitat For Humanity of Greater

Commencing at the Southwest corner of said Southwest Quarter
i (SW 1/4) and run East 1,020 links to the place of beginning; thence
run North for 75 feet; thence run East for 50 feet; thence run South
for 75 feet; thence run West for 50 feet to the place of beginning.
To have and to hold the same unto the said Grantee, and unto its
successors and assigns forever, with all tenements, appurtenances and
hereditaments thereunto belonging.
And we hereby covenant with said Grantee that we will forever warrant
and defend the title to said lands against all lawful claims whatsoever.
And we, Herman L. Martin and Sharron L. Martin, husband and wife, for
and in consideration of the said sum of money, do hereby release and
relinquish unto the said Grantee, and unto its successors and assigns forever,
all our right and possibility of dower, curtesy, and homestead in and to the
above-described real property,
