A RESOLUTION ESTABLISHING A RECORDS RETENTION POLICY FOR
THE BATESVILLE EMERGENCY DISPATCH OFFICE REGARDING
INCIDENT REPORTS AND ACCIDENT REPORTS AND FOR OTHER
PURPOSES.
WHEREAS, the City of Batesville Emergency Dispatch Department is
charged with responsibility of keeping records of accident reports, incident reports
and other records related to law enforcement within Independence County; and
WHEREAS, the volume of paper required to maintain these records has
caused tremendous problems with the storage space available; and
WHEREAS, there is a great need to establish a records retention policy
regarding the length of time accident reports and incident reports should be

maintained by the Department; now
BE IT THEREFORE RESOLVED AS FOLLOWS:
1. Accident reports shall be maintained by the Batesville
Emergency Dispatch Office for a period of five (5) years. Incident
reports which do not result in criminal charges shall be maintained
for a period of five (5) years.
2. The Director of the Dispatch Department at the end of each
calendar year will make an inventory of those incident and accident
reports that are more than five (5) years old, and will dispose of those
records.

3. Any such records that are more than five (5) years old and
currently still retained by the Dispatch Office will no longer be
retained.
4. Any record which is more than five (5) years old and still in
the possession of the Dispatch Department that has been requested
by a law enforcement agency shall be turned over to that law
enforcement agency and retained by it.
To the extent that this resolution is contradictory to the Arkansas Freedom
of Information Act or any other act of the Arkansas legislature, the Freedom of
Information Act or other legislative act will be controlling.
