SPECIAL MEETING
JULY 6, 2015
The Batesville City Council met in special session on July 6t" at 5:00 P.M. in the
Municipal Building. Mayor Rick Elumbaugh called the meeting to order. Upon roll call,
the following councilmembers answered present; Chris Beller, Tommy Bryant, Sonya
Crafton, Margarett Henley, Paige Hubbard, Doug Matthews, Chris Poole and David
Shetron. The City Clerk Denise Johnston was also present.
Councilmember Bryant moved to approve the prepared agenda and
Councilmember Henley seconded. All voted for.
SPECIAL MEETING BUSINESS
A) CONSIDER THE RESIGNATION AND APPOINTMENT FOR THE BATESVILLE
CITY ATTORNEY
Mayor Elumbaugh asked Mr. Lindsey Castleberry to come forward to address the
council. Mr. Castleberry told the council that he had given the Mayor a letter of
resignation effective July 2, 2015. He said he was grateful for the time he was
City Attorney and enjoyed working with the Mayor, Council and City Clerk. He
also said he was thankful to the citizens of Batesville who elected him to serve as
Batesville's City Attorney and hopes that he served them well. Mr. Castleberry
said he has accepted a job as an in-house attorney for White River Medical
Center. Mr. Castleberry told the council they have the authority to appoint a new
City Attorney according to ACA §14-43-412. The appointee must have a license
to practice law in the State of Arkansas and reside within the city limits of
Batesville. Mayor Elumbaugh thanked Mr. Castleberry for his service to the city
and wished him well in his new endeavor. Councilmember Henley moved to
accept Mr. Castleberry's letter of resignation and Councilmember Bryant
seconded and all voted for.
Councilmember Beller moved to go into executive session to discuss the office of
the City Attorney. Councilmember Hubbard seconded and all voted for. After a
brief time in executive session, Mayor Elumbaugh said the council wanted to
open the position up for applications. The Mayor encouraged anyone interested
in the position to submit a resume as soon as possible. He said he hoped to fill
the position at the next meeting on July 14tH
ADJOURNMENT
There being no further business, Councilmember Beller moved that the meeting
be adjourned. Councilmember Bryant seconded and all voted for.
