HomeMy WebLinkAbout2016-05-24 MINUTES OF COUNCIL MAY 24, 2016 The Batesville City Council met in regular session on May 24, at 5:30 P.M. in the Municipal Building. Mayor Rick Elumbaugh called the meeting to order. Utility Billing Supervisor Nick Baxter gave the invocation. Upon roll call, the following councilmembers answered present; Chris Beller, Tommy Bryant, Sonya Crafton, Margarett Henley, Paige Hubbard, Doug Matthews, Chris Poole and David Shetron. Also present were the City Attorney Tim Meitzen and Administrative Assistant Jennifer Corter. City Clerk Denise Johnston was absent. Councilmember Bryant moved to approve the minutes from the previous meeting. Councilmember Shetron seconded and all voted for. Councilmember Bryant moved to approve the amended agenda and Councilmember Henley seconded. All voted for. CITIZENS COMMENTS None OLD BUSINESS None NEW BUSINESS A) CONSIDER AN ORDINANCE ALLOWING THE SALE OF FIREWORKS WITHIN THE CITY LIMITS OF BATESVILLE, AR. Councilmember Bryant introduced an ordinance that will allow the sale of and public display of fireworks within the city limits through a permit process. Fire Chief Brent Gleghorn noted that permit applications can be picked up at the Fire Department. Councilmember Bryant moved to suspend the rules and read the ordinance by title only. Councilmember Shetron seconded and the electronic roll call count was 8 for and 0 against. Mr. Meitzen read the ordinance by title only. Councilmember Bryant moved that the rules be further suspended and waive the second and third readings. Councilmember Shetron seconded and the electronic roll call count was 8 for and 0 against. Councilmember Bryant moved to adopt the ordinance. Councilmember Beller seconded. The electronic roll count was 8 for and 0 against. The ordinance was given #2016-05-03. Councilmember Beller moved to adopt the emergency clause. Councilmember Bryant seconded and the electronic roll call count was 8 for and 0 against. B) CONSIDER AN ORDINANCE UPDATING THE SMOKING SECTION OF THE CITY'S EMPLOYEE HANDBOOK Councilmember Bryan introduced an ordinance to amend the City's Employee Handbook. When the handbook was recently updated, the smoking policy change was accidently left out. The changes will make the handbook conform to the Batesville Municipal Code regulating smoking on City owned properties. Councilmember Bryant moved to suspend the rules and read the ordinance by title only. Councilmember Henley seconded and the electronic roll call count was 8 for and 0 against. Mr. Meitzen read the ordinance by title only. Councilmember Bryant moved that the rules be further suspended and to waive the second and third readings. Councilmember Shetron seconded and the electronic roll call count was 8 for and 0 against. Councilmember Bryant moved to adopt the ordinance and Councilmember Beller seconded. The electronic roll call count was 8 for and 0 against. The ordinance was given #2015-05-03. C) EXECUTIVE SESSION Councilmember Beller moved to go into executive session. Councilmember Bryant seconded and all voted for. Upon returning from executive session, Councilmember Shetron moved that Ms. Willie Strong be appointed to the Housing Authority Board. Ms. Strong will replace Mr. Phillip Kerr who's term is about to expire. Councilmember Poole seconded and all voted for. Ms. Strong's 5 year term will expire on May 27, 2021. MAYOR COMMENTS Mayor Elumbaugh asked to move the next Council meeting to June 13th. With the Municipal League conference that week, Mayor Elumbaugh needed to be in Little Rock on Tuesday. Councilmember Matthews moved to change the meeting. Councilmember Bryant seconded and all voted for. Mr. Bob Carius was present to discuss the memorandum of understanding between the City of Batesville, Independence County, the Independence County Library and the Batesville Downtown Foundation. Dr. Beller expressed his concern with the Foundation being listed on the memo since there would be a separate lease for the Foundation and City partnership for the third floor. After some discussion, Mr. Carius and Mayor Elumbaugh will meet to work out the details. Mayor Elumbaugh noted that school is out now for summer break and cautioned drivers to watch out for children playing outside. Mayor Elumbaugh also announced the Memorial Flag Pole dedication at the Terry Sims Diamond Sports Complex will be Friday, May 27th at 1:00 p.m. He also said that a tentative ribbon cutting and dedication for the new Wastewater Treatment Plant is set for June 9th pending a response from the Governor's office. LIAISON REPORTS None COUNCIL COMMENTS Councilmember Bryant noted a recent article about the Airport and Manager Darren Wilkes. Councilmember Crafton thanked the Batesville Fire Department for coming to West Magnet School for their end of the year fun day. ADJOURNMENT There being no further business, Councilmember Bryant moved that the meeting be adjourned. Councilmember Matthews seconded and all voted for.
