HomeMy WebLinkAbout2013-04-23 MINUTES OF COUNCIL APRIL 23, 2013 The Batesville City Council met in regular session on April 23, at 5:30 PM at the Municipal Building. Mayor Elumbaugh called the meeting to order. Utility Office Manager Nick Baxter gave the invocation. Upon roll call, the following council answered present; Tommy Bryant, Margarett Henley, Paige Hubbard, Davy Insell, Fred Krug, Douglas Matthews, Chris Poole, and David Shetron. Also present were the City Clerk Denise Johnston and the City Attorney Lindsey Castleberry. Councilmember Bryant moved to approve the minutes from the previous meeting. Councilmember Shetron seconded and all voted for. Councilmember Bryant moved to approve the prepared agenda. Councilmember Matthew seconded and all voted for. CITIZENS COMMENTS None UNFINISHED BUSINESS None NEW BUSINESS A) CHIEF DEPUTY ALAN COCKRILL REGARDING METRO VEHICLE ACCIDENT Chief Deputy Alan Cockrill addressed the council and informed them that Metro Unit #553, a 2013 Dodge Charger, was involved in an accident. Officer Anthony Carter was driving to work and hit a deer. Chief Cockrill said at first inspection, he thought the vehicle could be repaired for around $9,000.00. However, when the Municipal League adjuster came he said the frame was bent and totaled the vehicle. The vehicle less all the equipment was $23,323.00. The Chief said Stanley Wood happens to have the exact same vehicle in stock that they ordered for Cedar Ridge School and the school decided not to purchase the vehicle. He said the adjuster said the City will receive insurance monies of$22,064.30 which is $1,608.70 less than the vehicle. He also said police vehicles are made once a year and they were lucky that Stanley Wood has this vehicle. If they do not purchase this vehicle they will have to wait until next year to replace it. Councilmember Shetron asked where the accident happened and he was told on Highway 69 near Sulphur Rock. He said the officer lives outside the City limits and the accident was unavoidable. Chief Cockrill said 11 of the 15 metro patrol officers live outside the City limits. Councilmember Bryant moved to purchase the vehicle from Stanley Wood to replace the totaled vehicle. Councilmember Insell seconded and all voted for. B) CONSIDER AN ORDINANCE TO REGULATE THE OPERATION OF PERSON TO PERSON SOLICITORS Chief Cockrill and Code Enforcement Officer Chad McClure addressed the council to discuss an ordinance to regulate the operation of person to person solicitors in the City of Batesville. The council discussed the ordinance and asked several questions. Councilmember Insell introduced the ordinance. Councilmember Matthews moved to suspend the rules and read the ordinance by title only. Councilmember Bryant seconded. The roll call count was 8 for and 0 against. Mr. Castleberry read the ordinance by title only. The ordinance will be placed on the agenda for the next council meeting. C) ENGINEER'S REPORT City Engineer Damon Johnson gave the council a brief update on projects throughout the City. D) REVIEW OF FEBRUARY AND MARCH FINANCIALS The council was given copies of the February and March, 2013 financials for review. MAYOR COMMENTS Mayor Elumbaugh asked Parks Director Jeff Owens to address and update the council on projects in the Parks Department. Mr. Owens first thanked all the department heads in the City for their help in various aspects throughout the Parks Department. He said the new construction projects would not be on schedule if not for all the help he has received. Mr. Owens updated the council on the all the projects in the parks and said the recent "Movies In The Park" was a great success. LIAISON REPORTS Councilmember Matthews said the "dirt" project at the Airport was almost complete and came in under budget. COUNCIL COMMENTS Councilmember Shetron asked Mr. Castleberry if he had heard anything about the burned out house on college Street. Mr. Castleberry said he contacted the attorney for the homeowners and expressed the council's concern over the property. He said it is still his position that the City should not get involved as long as there is pending litigation. ADJOURNMENT There being no further business, Councilmember Matthews moved that the meeting be adjourned. Councilmember Bryant seconded and all voted for. RICK ELUMBAUGH, MAYOR DENISE M.
