HomeMy WebLinkAbout2013-05-28 MINUTES OF COUNCIL MAY 28, 2013 The Batesville City Council met in regular session on May 28, at 5:30 PM at the Municipal Building. Mayor Elumbaugh called the meeting to order. Utility Office Manager Nick Baxter gave the invocation. Upon roll call, the following council answered present; Tommy Bryant, Margarett Henley, Davy Insell, Fred Krug, Douglas Matthews, and David Shetron. Also present were the City Clerk and the City Attorney. Councilmember Paige Hubbard and Chris Poole were absent. Councilmember Bryant moved to approve the minutes from the previous meeting. Councilmember Shetron seconded and all voted for. Councilmember Matthews moved to approve the prepared agenda. Councilmember Bryant seconded and all voted for. CITIZENS COMMENTS None UNFINISHED BUSINESS None NEW BUSINESS A) RECOGNIZE MR. OTIS HARPER FOR HIS 16 YEARS OF SERVICE TO THE CITY Mayor Elumbaugh recognized Mr. Otis Harper for his 16 years of service to the City of Batesville. Mr. Harper started for the City in July of 1997 in the Parks Department. In 2011 he was transferred to the Cemetery/Landscape Department. The Mayor read and presented Mr. Harper with a certificate and thanked him for his dedication to the City. B) THIRD AND FINAL READING OF AN ORDINANCE TO REGULATE THE OPERATION OF PERSON TO PERSON SOLICITORS Councilmember Matthews moved to suspend the rules and read the ordinance by title only. Councilmember Shetron seconded and the roll call count was 6 for and 0 against. Mr. Castleberry read the ordinance by title only. Ms. Henley said she was for the ordinance but still did not like the 7:00 PM quit time. She said during the winter months you will have solicitors after 5:00 PM when it is dark. She said she would like the ordinance to specify dawn to dusk. Mr. Castleberry said there is at least one city that has that provision in their ordinance, however, through his research, he thought the 9:00 AM to 7:00 PM times would be good for the City. Councilmember Matthews said this was a good start and the council could amend the ordinance at a later date if they felt the need to. Councilmember Shetron moved to adopt the ordinance and Councilmember Henley seconded. The roll call count was 6 for and 0 against. The ordinance was given #2013-05-02. C) CONSIDER AN ORDINANCE TO ANNEX CERTAIN PROPERTIES INTO THE CITY LIMITS OF BATESVILLE Councilmember Bryant introduced an ordinance that would annex certain properties located on General Street and Highway 167. Mr. Castleberry read the ordinance in full. Councilmember Matthews moved to suspend the rules and waive the second and third readings. Councilmember Bryant seconded and the roll call count was 6 for and 0 against. Councilmember Bryant moved to adopt the ordinance and Councilmember Matthews seconded. The roll call count was 6 for and 0 against. The ordinance was given #2013-05-03. D) DISCUSS HOUSES ON CHARLES AND BAYOU STREETS THAT WERE DONATED TO THE CITY BY CITIZENS BANK Mayor Elumbaugh said he talked with Habitat for Humanity as instructed by the council to see if they would like the properties located at Charles and Bayou Streets. He said at first they were interested but decided not to accept the properties due to their location and high traffic volume. The Mayor asked the council what they would like to do with the property. After a discussion, the council decided to put the properties up for bid with stipulation that both houses had to be removed from the properties. There are liens on the properties of approximately $2,400.00 that will have to be paid before the City can transfer the deeds. Councilmember Bryant moved to advertise the properties for sale and Councilmember Shetron seconded and all voted for. E) ENGINEER'S REPORT City Engineer Damon Johnson addressed the council and gave a brief update on activities throughout the City. MAYOR COMMENTS The council was informed of three fixed asset disposals. Two 2011 Dump Trucks that were traded in for new, 2013 Dump Trucks and Metro Unit#M53 that was totaled in an accident last month. The Mayor asked the council to remember the Gerald Gaither family in their thoughts and prayers. Mr. Gaither passed away this morning. He served as a councilmember for the City of Batesville from 1993 to 2004. LIAISON REPORTS None COUNCIL COMMENTS None ADJOURNMENT There being no further business, Councilmember Matthews moved that the meeting be adjourned. Councilmember Bryant seconded and all voted for.
