HomeMy WebLinkAbout2013-05-14 MINUTES OF COUNCIL MAY 14, 2013 The Batesville City Council met in regular session on May 14, at 5:30 PM at the Municipal Building. Mayor Elumbaugh called the meeting to order. Cemetery Supervisor Jonathan Abbott gave the invocation. Upon roll call, the following council answered present; Tommy Bryant, Margarett Henley, Paige Hubbard, Davy Insell, Fred Krug, Douglas Matthews, Chris Poole, and David Shetron. Also present were Jennifer Corter and the City Attorney Lindsey Castleberry. Denise Johnston, City Clerk was absent. Councilmember Krug moved to approve the minutes from the previous two meetings. Councilmember Bryant seconded and all voted for. Councilmember Insell moved to approve the prepared agenda. Councilmember Henley seconded and all voted for. CITIZENS COMMENTS None UNFINISHED BUSINESS None NEW BUSINESS A) MR. LARRY JONES WITH AN ECONOMIC DEVELOPMENT UPDATE Mr. Larry Jones addressed the Council with an Economic Development update. He reported on a proposal to relocate an existing warehouse operation, helping an out of town industrial prospect acquire property for a downtown railroad station area, assisting a local food processing company in the acquisition of additional land for future expansion and helping an Independence County based company get started with the manufacturing and packaging of a new product they have recently licensed. B) SECOND READING OF AN ORDINANCE TO REGULATE THE OPERATION OF PERSON TO PERSON SOLICITORS Councilmember Insell made a motion to read the ordinance by title only. Councilmember Bryant seconded and the roll call count was 8 for and 0 against. Mr. Castleberry read the ordinance by title only. Councilmember Henley expressed her concern about the hours set for solicitors. Mr. Castleberry stated that municipal league recommends 9:00 p.m. to be the ending time but he felt that 7:00 p.m. would be a good middle ground for Batesville. It was discussed using similar regulations as the hunting guidelines, when it became dark, but that in the winter time it gets dark at 5:00 p.m. and most people are just getting off work at that time. There being no more discussion the item will be placed on the next agenda for the third and final reading. C) CONSIDER A RESOLUTION TO REVISE AND UPDATE THE COMPREHENSIVE PLAN Councilmember Bryant introduced the resolution to revise and update the Comprehensive Plan. Mr. Chad McClure came before the Council to discuss several changes that need to be made to the plan. Mr. Castleberry read the resolution in full. Councilmember Bryant made a motion to adopt the resolution. Councilmember Insell seconded and the roll call count was 8 for and 0 against. The Resolution was given # 2013-05-01-R. D) CONSIDER AN ORDINANCE TO AMEND THE BATESVILLE ZONING DISTRICT MAP AND OTHER PUROPSES Councilmember Insell introduced an ordinance to amend the Batesville Zoning District map and other purposes. Mr. McClure discussed that Mr. and Mrs. Terrell Tebbetts have requested that their property located at lot 5 of block 10 School Addition be re-zoned from T-1(Traditional Business District) to R-2 (General Family Residential). Councilmember Shetron made a motion to read the ordinance by title only. Councilmember Bryant seconded and the roll call count was 8 for and 0 against. Mr. Castleberry read the ordinance by title only. Councilmember Matthews made a motion to suspend the rules and waive the second and third reading. Councilmember Insell seconded. The roll call count was 8 for and 0 against. Councilmember Matthews made a motion to adopt the ordinance. Councilmember Bryant seconded and the roll call was 8 for and 0 against. The ordinance was given #2013-05-01. E) EXECUTIVE SESSION Councilmember Shetron made a motion to go into executive session. Councilmember Matthews seconded. Motion passed. Upon returning from executive session, Councilmember Matthews made a motion to reappoint Ms. Sylvia Crosby to the Housing Authority Commission. Councilmember Bryant seconded. Motion passed. F) ENGINEER'S REPORT City Engineer Damon Johnson gave the council a brief update on projects throughout the City including Sewer and Water line replacements on Westside, WWTP update, electrical project at the Water Plant, drainage improvements on Lomond and curb and guttering at the museum. Mr. Johnson talked about the condition of sidewalks inside the City and about encouraging citizens to avoid parking or driving on the sidewalks. G) REVIEW OF APRIL FINANCIALS The council was given copies of the April, 2013 financials for review. MAYOR COMMENTS Mayor Elumbaugh read a National Kids to Parks Day Proclamation. The City of Batesville has set aside May 24th as a day to encourage kids and adults as well to get out and enjoy the beautiful parks not only in the City of Batesville but the surrounding areas. There will be a free Movie in the Park on May 24th LIAISON REPORTS None COUNCIL COMMENTS None ADJOURNMENT There being no further business, Councilmember Bryant moved that the meeting be adjourned.
