DECEMBER 18, 2012
The Batesville City Council met in regular session on December 18, at 4:45 PM
at the Municipal Building. Mayor Elumbaugh called the meeting to order. Utility Billing
Supervisor Nick Baxter gave the invocation. Upon roll call, the following council
answered present; Tommy Bryant, Paige Hubbard, Davy Insell, Fred Krug, Douglas
Matthews, Chris Poole, and David Shetron. Also present were the City Clerk and the
City Attorney. Councilmember Margarett Henley was absent.
Councilmember Bryant moved to approve the minutes from the previous
meeting. Councilmember Insell seconded and all voted for.
Councilmember Matthews moved to approve the prepared agenda.
Councilmember Bryant seconded and all voted for.

NEW BUSINESS
A) CONSIDER AN ORDINANCE TO ADOPT THE 2013 BUDGET
Councilmember Bryant introduced an ordinance to adopt the 2013 budget for
each and every department within the City. Councilmember Matthews moved to
read the ordinance by title only. Councilmember Bryant seconded and the roll
call count was 7 for and 0 against. City Attorney Lindsey Castleberry read the
ordinance by title only. Councilmember Bryant moved to further suspend the
rules and waive the second and third readings. Councilmember Insell seconded
and the roll call count was 7 for and 0 against. Councilmember Matthews moved
to adopt the ordinance and Councilmember Bryant seconded. The roll call count
was 7 for and 0 against. The ordinance was given #2012-12-01. Mr. Castleberry
read the emergency clause and Councilmember Bryant moved to adopt.
Councilmember Matthews seconded and the roll call count was 7 for and 0
against.
B) CONSIDER AN ORDINANCE TO ADOPT THE ARKANSAS ENERGY CODE
Councilmember Matthews introduced an ordinance for the adoption of the 2011
Arkansas Energy Code for the purpose of establishing rules and regulations for
energy efficient standards for new building construction. Councilmember
Matthews moved to read the ordinance by title only. Councilmember Insell
seconded and the roll call count was 7 for and 0 against. Mr. Castleberry read
the ordinance by title only. Councilmember Bryant moved to further suspend the
rules and waive the second and third readings. Councilmember Insell seconded
and the roll call count was 7 for and 0 against. Councilmember Matthews moved
adopt the ordinance. Councilmember Bryant seconded and the roll call count
was 7 for and 0 against. The ordinance was given #2012-12-02.
MAYOR COMMENTS
Mayor Elumbaugh said he has a conflict with the first meeting in January, 2013.
Councilmember Matthews moved to cancel the first scheduled meeting in
January 2013. Councilmember Bryant seconded and all voted for.

ADJOURNMENT
There being no further business, Councilmember Bryant moved that the meeting
be adjourned. Councilmember Insell seconded and all voted for.
