HomeMy WebLinkAbout2011-06-21-SPECIAL MEETING MINUTES OF COUNCIL SPECIAL MEETING JUNE 21, 2011 The Batesville City Council met in special session on June 21, at 5:15 PM at the Municipal Building. Mayor Elumbaugh called the meeting to order. Upon roll call, the following council answered present; Tommy Bryant, Margarett Henley, Paige Hubbard, Davy Insell, Fred Krug, Douglas Matthews, Chris Poole, and David Shetron. Also present were the City Clerk and the City Attorney. SPECIAL BUSINESS A) CONSIDER ALLOWING JACK KREPPS TO PLACE THE MARY WOOD NO. 2 AT KENNEDY PARK Mayor Elumbaugh opened the discussion saying he was concerned with parking at Kennedy Park. He said he drove the park Sunday and the parking lot was completely full with vehicles and boat trailers. He said he didn't think the park would allow for any additional parking. He also added that the Parks Commission had discussed building several RV pads in the same proximity. Councilmember Matthews said he had a list of concerns. He first said he thought the request should go through the Parks Commission to make sure it would be a part of their long range plan for the City's parks. He said the City needed at least a 10% bond and Mr. Krepps needed to produce a site plan, Engineering studies and proof of liability insurance for before, during and after the project. He said since the proposed site is next to the boat ramp built by the Game and Fish Commission, their approval may be needed and well as approval from the Corp of Engineers and possible environmental studies. Lastly he said a time element was also a must. Dr. Matthews said this list should be met by any and all projects be considered on City property. Councilmember Shetron said he agreed with Dr. Matthews and added that an Architectural drawing should be approved first by the Parks Commission and then recommended to the council. Councilmember Hubbard said she agreed that procedures needed to be in place but they should not be so difficult that no one would try to do anything in our City in the future. City Attorney Castleberry addressed the council and said there nothing legally to prohibit the city from contracting with Mr. Krepps on the project. He said however, that the contract should include a bond with an amount agreed upon by the council, a set of plans with an Engineering stamp of approval, a time limit for completion and insurance requirements. The council agreed that this could not be done within the next week and Mr. Krepps has to have the boat moved soon. They asked Mr. Krepps is there was any place between Newport and Batesville that he could temporally anchor the boat until these details could be ironed out. Mr. Krepps said he didn't know and that he had not looked for any temporary place. Councilmember Shetron moved to table any decision and to refer the issue to the Parks and Recreation Commission. Councilmember Matthews seconded and all voted for. B) CONSIDER PAYING FOR INTERNET SERVICES AT THE SHERIFF'S WESTSIDE SUB-STATION Mayor Elumbaugh said the Sheriff's Department had sent the Clerk's office a bill to pay for Internet services at the Westside Sub-station. Ms. Johnston said she read back at a previous meeting and the Sheriff said the Citizens Bank was going to pay for the Internet for the station. Ms. Johnston said she visited with the Sheriff and he said that was the banks intention but banks security department would not let the Sheriff's Department "piggy-back" off their internet. Therefore, they had to get their own service. The bill will run $70.00 per month. After a discussion, the Mayor offered to pay for the internet service out of his discretionary funds through the end of the year and they could discuss continuing next year during the budget process. Councilmember Krug moved to authorize the payment for internet service for the rest of the year out of the Mayor's discretionary fund. Councilmember Bryant seconded and all voted for.
