AN ORDINANCE AUTHORIZING WITHDRAWAL FROM THE
INTERLOCAL AGREEMENT ON LAW ENFORCEMENT,DECLARING AN
EMERGENCY,AND FOR OTHER PURPOSES.
WHEREAS, the City of Batesville and Independence County currently
participate in an Interlocal Agreement which sets out their respective rights and
obligations regarding law enforcement within the county;
WHEREAS, the present version of the Interlocal Agreement was adopted by the
City of Batesville on July 10,2012, and is set to expire in July of 2017;
WHEREAS, in efforts to make a decision with respect to continued participation
in the Interlocal Agreement, the current status of police protection has been examined
and the findings of a feasibility study have been reviewed.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
BATESVILLE, ARKANSAS:
Section 1. Pursuant to Section A of the Interlocal Agreement, the City of
Batesville hereby elects to withdraw from the Agreement, terminating the same.
Section 2. The City Attorney is directed to give written notification to
Independence County as required by the Agreement.
Section 3. Per the terms of the Interlocal Agreement, it shall terminate at the
end of the six(6)month period following notification.
Section 4. This ordinance repeals any ordinances or parts of ordinances in
conflict herewith.
Section 5. EMERGENCY CLAUSE: Because the orderly administration of law
enforcement in the City of Batesville is vital for the protection of life, liberty, and
shall be in full force and effect from and after its passage.
