HomeMy WebLinkAbout2014-10-01 ORDINANCE NO. 2014 - AN 014 -AN ORDINANCE TO WAIVE COMPETITIVE BIDDING AND AUTHORIZE THE BATESVILLE UTILITY DEPARTMENT TO CONTRACT FOR TRANSITION OF WASTEWATER FLOW FROM THE PUMP SYSTEM TO THE RECENTLY CONSTRUCTED GRAVITY TUNNEL WHEREAS, the City of Batesville has continued to work on wastewater improvements pursuant to a measure approved by the voters in 2009; WHEREAS, the Batesville Utility Department, in the early phases of implementing wastewater improvements, contracted for the construction of a gravity tunnel to replace the existing pump system; WHEREAS,the Batesville Utility Department has continued work on the project, and the current contractor is required to demolish the pump system infrastructure in order to complete its scope of work; and WHEREAS,the gravity tunnel must be in operation before the existing pump system can be demolished. NOW,THEREFORE,BE IT ORDAINED BY THE CITY COUNCIL OF BATESVILLE,ARKANSAS: Section 1.That the transition from the current pump system to the gravity flow system is a time-sensitive project that must be performed without delay in order for the remainder of the overall project to proceed. Section 2. That the transition project at issue was initially slated for inclusion in a much larger contract upon which the City of Batesville will accept bids,but the contract documents and bid specifications for that larger overall project have been delayed. Section 3. That the Batesville Utility Department should be allowed to contract with Rosetta Construction for the project of transitioning from the current pump system to the gravity flow system at a cost of$300,000.00, more or less. Section 4. That the City Council in accordance with the terms of A.C.A. Section 14-58-303 hereby waives the requirement of competitive bidding and authorizes the Batesville Utility Department to contract for the transition from the pump system to the gravity system for the price set forth in Section 3 above. { Section 5. EMERGENCY CLAUSE: It is further found that due to the immediate need to acquire the above utility program, an emergency is declared to exist and this ordinance being necessary for the preservation of the public peace,health and safety shall take effect from and after its passage and approval.
