AN ORDINANCE REGULATING THE DRIVING OF Vht.i.CLES; <br />FIXING PENALTIES FOR DRIVING WHILE UNDER INFLUENCE OF <br />INTOXICATING LIQUOR OR NARCOTIC DRUGS, AND FOR RECKLESS <br />DRIVING <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BATESVILLE, <br />ARKANSAS: <br />Section 1. It is unlawful for any person who is an habitual <br />user of narcotic drugs or any person who is under the influence of <br />intoxicating liquor or narcotic drugs to drive any vehicle within <br />the City of Batesville, Arkansas, <br />Seotio_n 2. Every person whoj is oonvlcted before the Mayor of a <br />violation of aforesaid Section 1 shall be punished by imprison- <br />ment for not less than 10 days nor more than 1 year, or by fine of <br />not less than $100.00 nor more than $19000.00, or by both such fine <br />and imprisonment. On a second or subsequent conviction he shall be <br />punished by imprisonment for not less than 90 days nor more than <br />1 year, and, in the discretion of the court, a fine of not more <br />than $1000.00. <br />Section 3. Any person who drives any vehicle within the City of <br />Batesville, Arkansas, in such a manner as to indicate either a <br />willful or a wanton disregard for the safety of persons or proper <br />is guilty of reckless driving. <br />Section 4. Every person convicted before the Mayor of a violation <br />of aforesaid Section 3 shall be punished by imprisonment for a <br />period of not less than 5 days nor more than 90 days, or by fine <br />of not less than $25.00 nor more than $500.009 or by both such fine <br />and imprisonment. On a second or subsequent conviction he shall <br />be punished by imprisonment for not less than 10 days nor more than <br />6 months, or by a fine of not less than $50.00 nor more than $10000009 <br />or by both such fine and imprisonment. <br />Section 5. All ordinances and parts of ordinances in conflict here- <br />with are hereby repealed, and it is ascertained and declared that <br />the loss of life and property under our present laws creates an <br />emergency; therefore this ordinance being necessary for the immedi- <br />ate preservation of the public peace, health and safety shall be in <br />full force and effect from and after passage and publication. <br />APPROVED: <br />Passed: � j '��� J�;_''1`"' <br />Attest; 'rf'jsay, �f K xayor. <br />alty cor er. <br />
