MINUTES OF COUNCIL <br /> SPECIAL MEETING <br /> JULY 27, 2005 <br /> The Batesville City Council met in special session on July 27, at 5:00 PM <br /> at the Municipal Building. Mayor Joe Biard presided over the meeting. <br /> Councilmember Krug gave the invocation. Upon roll call the following <br /> Councilmembers answered present: John Cooke, Fred Krug, Doug Matthews, <br /> Jerry Pectol, and Stephen Smart. The City Clerk was also present. <br /> Councilmembers Terrell and Carpenter arrived late. Councilmember Mynatt and <br /> City Attorney Scott Stalker were absent. <br /> Councilmember Cooke moved to approve the prepared agenda. <br /> Councilmember Matthews seconded and all voted for. <br /> DISCUSSION OF ELECTION <br /> The Independence County Election Commissioners were present to <br /> discuss the possibility of calling a special election. Because of the certification of <br /> signatures on two petitions for referendum concerning the Hamburger & Hotel <br /> Tax and Business License ordinances recently passed by the council, the council <br /> has to decide whether to call for a special election or pass an ordinance <br /> repealing the Hamburger and Hotel Tax and Business Licenses ordinances. The <br /> Election Commissioners present were Harold Wilson, Charlie Morris, John <br /> Bennett and Dwayne Millikin. Councilmember Pectol moved to call for a special <br /> election and Councilmember Krug seconded. The roll call count was 5 for and 0 <br /> against. Councilmembers Terrell and Carpenter entered the meeting and both <br /> wanted to go on record as being for the special election. Mr. Morris said the cost <br />
